November 19, 2007 (Regular Meeting) <br />Page 634 <br />The MOTION carried with Chairman Carruth, Vice Chairman Juba and <br />Commissioners Mynatt and White voting for and Commissioner Privette voting <br />against. <br />(G-5) Consent Agreement Renewal - Hampden Village Subdivision <br />Kassie Watts, Planner, presented the following information related to a <br />Consent Agreement renewal for Hampton Village subdivision project: the <br />developer is Metro Development Group; the subdivision was originally approved <br />by the Concord Planning and Zoning Board on December 15, 2005 for 193 single- <br />family residential lots and the preliminary plat was revised to 176 single- <br />family residential lots and approved administratively on November 1, 2006; <br />the project consists of approximately 97 acres located on Roberta Road; the <br />Cabarrus County Board of Commissioners approved a Consent Agreement for <br />Hampden Village on February 20, 2006 and the current Consent Agreement is set <br />to expire on December 15, 2007, which is two years from the date of the <br />original preliminary plat approval; the existing Agreement includes the <br />payment of $9,039.00 per single-family lot to advance school adequacy and is <br />due at final platting; the Agreement also includes the following build-out <br />schedule of no more than 60 lots platted in calendar year 2007, no more than <br />60 lots platted in calendar year 2008 and no more than 56 lots platted in <br />calendar year 2009; the Agreement also states the number of Certificates of <br />Occupancy (CO's) issued shall not exceed 30 in calendar year 2007, shall not <br />exceed 60 for calendar year 2008, shall not exceed 60 for calendar year <br />2009, and shall not exceed 26 for calendar year 2010. Ms. Watts also stated <br />the availability of the developer, Judson Stringfellow, to respond to <br />questions. <br />Mr. Stringfellow and Ms. Watts responded to several questions from the <br />Board. Mr. Stringfellow also commented on the delay associated with the <br />installation of a sanitary sewer line and the discovery of rock on the site. <br />There was also a brief discussion on the extension of the consent agreement <br />and Ms. Watts responded to additional questions. <br />Vice Chairman Juba MOVED to approve the Consent Agreement renewal for <br />one year between Cabarrus County and Metro Development Group for the Hampden <br />Village subdivision, including payment of $4,034.00 per single family lot <br />(due at final platting) to advance school adequacy and the following build- <br />out schedule and Certificates of Occupancy schedule: <br />Calendar year 2007, <br />Calendar year 2008, <br />Calendar year 2009, <br />Calendar year 2007; <br />Calendar year 2008; <br />Calendar year 2009; <br />Calendar year 2010; <br />no more <br />no more <br />no more <br />no more <br />no more <br />no more <br />no more <br />than <br />than <br />than <br />than <br />than <br />than <br />than <br />60 lots platted; <br />60 lots platted; <br />56 lots platted; <br />30 Certificates of Occupancy; <br />60 Certificates of Occupancy; <br />60 Certificates of Occupancy; <br />26 Certificates of Occupancy. <br />Commissioner Mynatt seconded the motion. <br />Commissioner Privette commented on the overcapacity of several schools <br />and stated his intent to vote against the motion. <br />The MOTION carried with Chairman Carruth, Vice Chairman Juba and <br />Commissioners Mynatt and White voting for and Commissioner Privette voting <br />against. <br />Chairman Carruth initiated a general discussion on the possibility of <br />having the City Councils that approve the subdivision projects also finalize <br />the consent agreements. He also asked to have the number of homes approved <br />by the Cities versus the County for a five-year period prior to the change to <br />the Cabarrus County Zoning Ordinance in 2005. <br />Ms. Watts stated she could have the information ready by the next <br />agenda work session and distributed the latest subdivision inventory <br />spreadsheet. <br />(G-6) Proposed Revision of the National Ambient Air Quality Standards for <br />Ozone 6 Adoption of Resolution <br />UPON MOTION of Commissioner White, seconded by Commissioner Privette <br />and carried unanimously, the Board adoptedthe following resolution: <br />Resolution No. 2007-31 <br />
