December 17, 2007 (Regular Meeting) Page 657 <br />Kassie Watts, Planner, presented a Consent Agreement for Rocky Glen <br />subdivision, developed by Randall T. Scribner and approved by the Cabarrus <br />County Planning and Zoning Board on July 19, 2007. The project consists of <br />99 single family lots on +/-35.989 acres located on Rocky River Road. The <br />Consent Agreement includes the payment of $4,039.00 per lot (due at final <br />platting) to advance school adequacy and the following build-out schedule: <br />no more than 14 lots to be platted in 2008, no more than 17 lots to be <br />platted in 2009 and no more than 18 lots to be platted in 2010. Finally, she <br />stated the availability of Mr. Scribner, the developer, to respond to <br />questions. <br />Vice Chairman Juba MOVED to approve the Consent Agreement between <br />Cabarrus County and Randall T. Scribner for the Rocky Glen subdivision, <br />including the payment of $4,039.00 per lot to advance school adequacy (due at <br />final platting) and the following build-out schedule: no more than 19 lots <br />to be platted in 2008, no more than 17 lots to be platted in 2009 and no more <br />than 18 lots to be platted in 2010. She further moved to authorize the <br />County Manager to execute the Agreement on behalf of Cabarrus County. <br />Commissioner Mynatt seconded the motion. <br />After commenting on the capacities of the elementary, middle and high <br />schools and the shortage of water, Commissioner Privette stated his intent to <br />vote against the motion. <br />The MOTION carried with Chairman White, Vice Chairman Juba and <br />Commissioners Carruth and Mynatt voting for and Commissioner Privette voting <br />against. <br />7 <br />American Communications <br />Inc. - <br />Clay Andrews, Cabarrus Economic Development Recruiter, stated the <br />details of the project as originally presented have changed and for accuracy <br />purposes, he asked to have the public hearing rescheduled to January 7, 2008. <br />Chairman White stated a public hearing had been advertised for tonight <br />and asked if there was anyone present who would like to speak on this issue. <br />At 7:41 p.m., Chairman White opened the public hearing on the Industrial <br />Development Incentive Grant for American Communications Network, Inc., (ACN), <br />a subsidiary of LKN Communications Network, Inc. The public hearing notice <br />was published in THE INDEPENDENT TRIBUNE and THE CHARLOTTE OBSERVER (Cabarrus <br />Neighbors) on December 6, 2007. <br />Jerry Williamson, resident of 2206 Moose Road in Kannapolis, commented <br />on the practice of new businesses receiving incentives from the County and <br />the City independently. He suggested the City and County prepare one <br />incentive package. Also, he asked if any research had been conducted to <br />determine if the business received incentives at their present location and <br />how long they stayed. He further suggested businesses that receive <br />incentives be required to stay in Cabarrus County for at least 20 - 30 years. <br />Finally, he commented on the County's low unemployment rate. <br />With there being no one else to address the Board, the public hearing <br />was closed. <br />Chairman White stated because the specifics of the incentive grant has <br />changed since it was advertised, he suggested the Board re-advertise and hold <br />a public hearing on January 7, 2008. <br />At the request of the Board, Mr. Andrews explained this project is <br />moving at a faster pace than usual and that projects like this one do not <br />usually receive State matching funds. In this case, he said the company is <br />bringing headquarter-type jobs to this location and the State has agreed to <br />provide a One North Carolina grant of $1,000.00 per job, up to 300 jobs. He <br />said the One North Carolina grant requires local governments to match the <br />grant dollar for dollar, which required the incentive to be recalculated. <br />He also responded to several questions related to jobs and a general <br />discussion ensued. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board scheduled a public hearing for an <br />Industrial Development Incentive Grant for American Communications Network, <br />Inc., (ACN), a Subsidiary of LKN Communications Network, Inc. (99 percent of <br />the ad valorem taxes/5 years) on January 7, 2008 at 3:30 p.m. <br />
