<br />February 20, 2006 - Regular Meeting <br /> <br />Page <br /> <br />505 <br /> <br />Recess of Meeting <br /> <br />Chairman Carruth called for a short recess at 9:40 p.m. <br /> <br />Chairman Carruth reconvened the meeting at 9:55 p.m. <br /> <br />(E-2) NC 73 Small Area Land Use and Economic Development Plan - Public <br />Hearing <br /> <br />The proposed NC 73 Small Area Land Use and Economic Development Plan <br />was presented to the Board on January 23, 2006. At that time, the Board set a <br />public hearing for the February 20th meeting. The Cabarrus County Planning <br />and Zoning Commission approved the Plan at its November 2005 meeting. <br /> <br />Colleen Nelson, Senior Planner, was present to answer any questions by <br />the Board. <br /> <br />At 9:57 p.m., Chairman Carruth opened the public hearing for the NC 73 <br />Small Area Land Use and Economic Development Plan and asked if anyone was <br />present who wished to address the Board. The Public Hearing Notice was <br />published in THE INDEPENDENT TRIBUNE on February 6 and 19, 2006. <br /> <br />There was no one present to address the Board, and Chairman Carruth <br />closed the public hearing. <br /> <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the NC 73 Small Area Land Use and <br />Economic Development Plan as recommended by the Cabarrus County Planning and <br />Zoning Commission. <br /> <br />The NC 73 Small Area Land Use and Economic Development Plan as adopted <br />by the Board is on file in the Office of the County Manager. <br /> <br />(E-3) Consent Agreement for the Hampden Village Subdivision Project <br /> <br />Kassie Goodson, Planner, presented the proposed Consent Agreement for <br />the Hampden Village subdivision that was approved by the City of Concord in <br />December 2005. This item was deferred by the Board at its January 23rd <br />meeting. Ms. Goodson reviewed the phasing schedule for the development which <br />provided for the platting of lots beginning in 2006 and the issuance of <br />certificates of occupancy beginning in 2007. She stated the developer had <br />agreed to pay $4,034.00 per lot to address school adequacy needs and to pay <br />at final platting rather than building permitting. Finally, she advised that <br />the developers were present to answer any questions. <br /> <br />There was discussion as to which schools children in the subdivision <br />would attend and the adequacy of those schools. The Board also discussed the <br />approval of subdivisions by the City of Concord, review of school adequacy <br />issues and consideration of Consent Agreements by the Board. <br /> <br />Mr. Day reminded the Board there will be a joint meeting with the two <br />school boards on February 27 to review the draft Adequate Public Facilities <br />Ordinance. <br /> <br />Jonathan Marshall, <br />Village Development would <br />facilities requirements. <br /> <br />Commerce Director, clarified that the Hampden <br />be subject to the County's current adequate public <br /> <br />UPON MOTION of Chairman Carruth, seconded by Vice Chairman Juba with <br />Chairman Carruth, Vice Chairman Juba and Commissioners Carpenter and Freeman <br />voting for and Commissioner Privette voting against, the Board approved the <br />Consent Agreement with Metro Development Group, LLC, for the Hampden Village <br />Development as submitted with the adequate public facilities fee in the <br />amount of $4,034.00 per lot to be paid at the time of final platting rather <br />than building permitting. <br /> <br />(E-4) Public Comment Period Policy <br /> <br />Chairman Carruth distributed a revised proposal for a Public Comment <br />Period Policy. He stated it was never his intent to limit free speech and <br />reviewed the following proposal which he stated would enhance public comment <br />and citizen input. <br /> <br />Citizen Input at Commissioner Meetings <br /> <br />1.
