He said the plan does not accurately depict what will <br />be built and no one has committed to building anything but a concrete plant. <br />He said the petition is deceptive because a local gas station is described as <br />a "historical crossroads" and reported there are gas stations everywhere. He <br />said Mr. Wayne is trying to sell a plan based on a retail area and is not <br />focused on the central case for the rezoning which is the heavy commercial <br />concrete business. He reported truck and heavy equipment noise will be a <br />significant impact to the community; the County already has designated <br />commercial areas and the County should not deviate from its plan; and the GC <br />zoning designation is completely at the opposite end of the spectrum from AO <br />and MDR. <br /> <br />Rebuttals - Proponents <br /> <br />Chairman Carruth stated that 10 minutes has been set aside for each side for <br />rebuttals. <br /> <br />Fletcher Hartsell, Jr. stated that no one doubts that there are <br />problems with roads, but the question is how you fix the roads. He asked if <br />the County or the State will fix the roads or will the Board decide to <br />partner with someone who will do something to make the roads safer. He said <br />everybody complains about the roads and the petition provides a way to fix a <br />portion of the road. He pointed out the conditional district is a better <br />zoning classification than a general district because the County has the <br />abili ty to control it. He said Mr. Wayne has done the best to he can to <br />submi t a plan that is complete enough to be identified by County staff. He <br />said the phasing is logical because Phase 3 cannot be completed until certain <br />improvements have been made to the roads and parts of Phase 2 cannot be <br />completed until there are other utili ties. Presently, he said there is a <br />large site zoned OI and if nothing happens, the County will have 650,000 <br />square feet of facilities without architectural drawings. He reported <br />mistakes were made in the original application, but now there are assurances <br />that those things will not be done. He said the specifics of this <br />application are far superior to what the County has now. He reported there <br />is a need for a school in that area of the County, which will require <br />utilities and produce traffic. In this situation, he said the County will be <br />responsible for these improvements and will not have a partner. He said this <br />application is specific; the County has control over it; and is a far better <br />situation than the County would have otherwise. <br /> <br />Keith Wayne stated the wide loads and heavy trucks traffic are minimal, <br />and the heavy trucks are serviced in the field. He said his company did not <br />create all the traffic problems in the Northwest community. The traffic <br />congestion, he said is a compilation of many projects, including rural <br />development and rapidly developed single family homes. He said his company <br />shares the roads and pays their portion of taxes. He cited Ritchie Hearne's <br />letter, which said the roads need to be improved and these improvements will <br />have to be made whether or not this rezoning is approved. He said he does not <br />understand why the residents are blaming him for the road conditions; <br />apparently the residents do not want the roads improved and have said they <br />will not grant him right-of-ways. Wi th regard to completing the proposed <br />proj ect, he challenged the community to look at his prior development track <br />record. He said he has been sensitive to neighbors' concerns and have <br />followed every rule. He said the strategic plan has changed because Wayne <br />Brothers waited too late to start the process, so in order to accommodate <br />their needs, the company will need to move outside Cabarrus County while the <br />corporate headquarters are built. He reiterated the concrete plant has been <br />removed from the proposed plan. <br /> <br />Rebuttals - Opponents <br /> <br />Fred Wally reported there have been three satellite annexations in the <br />Odell Community off Jim Johnson Road that includes 1,200 homes. He said a <br />high school is needed in this area of growth; a school adds value to the <br />community and is a better use of the property. He stated there are two types <br />of citizens present tonight: 1) residents who care about the community and <br />want the property remain zoned as OI and (2) employees and contractors hired <br />by Wayne Brothers and will financially gain from the proj ect. He asked the <br />Board to think about the zoning regulations and General Statues they are <br />required to uphold. Finally, he said the property needs to maintain its <br />original OI zoning classification; and the same laws that protect the <br />property owner should also protect the residents. <br /> <br />William E. Morrison, Sr. of 866 Concord Road in Davidson asked if an <br />exact description of how the utilities will be provided is a requirement of a <br />
