October 30, 2006 (Regular Meeting) <br />Page 148 <br />The NCDOT Board of Transportation approved the abandonment of state <br />maintenance on a portion of Macedonia Church Road on September 7, 2006. The <br />County is required to hold a public hearing on the abandonment. <br />At 7:59 p.m., Chairman Carruth opened the public hearing on the <br />Abandonment of State Maintenance on a Portion of Macedonia Church Road. The <br />Public Hearing Notice was published in THE INDEPENDENT TRIBUNE on October 19 <br />and 26, 2006. <br />There was not one present to address the Board, and Chairman Carruth <br />closed the public hearing. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Freeman and <br />unanimously carried, the Board approved the abandonment of state maintenance <br />on a portion of Macedonia Church Road (SR 1620). <br />(G-3) Consent Agreement - Hedford Farina Subdivision <br />Jonathan Marshall, Commerce Director, presented a Consent Agreement for <br />Bedford Farms Subdivision. The subdivision, developed by Niblock Development <br />Corporation, was approved by the Concord Planning and Zoning Board on July <br />18, 2006, and consists of 166 single family homes on 116.891 acres on Heqlar <br />Road. He said the Consent Agreement provides for the advancement of school <br />adequacy at $9,039.00 per lot that will be due at final platting. At the <br />work session, he said there was a request from a Board member to extend the <br />build out schedule from three to five years. The revised build out schedule <br />is as follows: no more than 38 lots platted in 2007, no more than 38 lots <br />platted in 2008, no more than 36 lots platted in 2009, no more than 38 lots <br />platted in 2010 and no more than 19 lots platted in 2011. He reported <br />including previously .approved subdivisions, the following schools will be <br />functioning at the following capacity upon completion of the Bedford Farms <br />subdivision project: W. M. Irvin Elementary School - 116 percent, Mt. <br />Pleasant Middle School - 132.58 percent and Mt. Pleasant High School - 119.62 <br />percent. <br />Mr. Marshall responded to questions on the calculation of school <br />capacity percentages and the supply of water to this subdivision. There was <br />also a brief discussion on the Inter Basin Transfer. <br />Chairman Carruth made a motion to approve the Consent Agreement. <br />Vice Chairman Juba seconded the motion. <br />Commissioner Privette made an amendment to delay this project until the <br />County has assurance that school facilities are adequate. He cited the <br />capacity percentages of the elementary, middle and high school and said it <br />will be 2011 before the elementary school is completed, 2012 before the <br />elementary school is completed and 2013 before the high school is completed. <br />Commissioner Privette's amendment died for lack of a second. <br />Commissioner Privette commented on the County's practice of continually <br />approving subdivisions without adequate school facilities, the lack of <br />adequate water resources and stated his intent to vote against the motion. <br />Chairman Carruth pointed out the County is considering a Consent <br />Agreement and that the majority of subdivisions are approved by <br />municipalities. <br />UPON MOTION of :Chairman Carruth, seconded by Vice Chairman Juba with <br />Chairman Carruth, Vice Chairman Juba and Commissioners Carpenter and Freeman <br />voting for and Commissioner Privette voting against, the Board approved the <br />Consent Agreement between Cabarrus County and Niblock Development Corporation <br />for the Bedford Farms .Subdivision, including the payment of $9,039.00 per lot <br />to advance school adequacy and a build out schedule of no more than 38 lots <br />platted in 2007, no more than 38 lots platted in 2008, no more than 36 lots <br />platted in 2009, no more than 36 lots platted in 2010 and no more than 19 <br />lots platted in 2011..
