The MOTION <br />died for lack of a second. <br />Commissioner White made a MOTION to table the decision on the Consent <br />Agreement for Castlebrooke Manor Subdivision until staff could discuss the <br />possibility of extending the build-out schedule with the developer. <br />Chairman Carruth recognized Mr. Terral Lambert of Trinagle Development <br />who was in attendance at the meeting. <br />Mr. Lambert reported the current build-out schedule was based on the <br />lay of the land and he would have to pay the advancement of adequacy at final <br />platting. However, he said he was willing to extend the build-out by one <br />year bringing the schedule to no more than 27 lots in 2007, no more than 15 <br />lots in 2008, no more than 15 lots in 2009 and no more than 13 lots in 2010. <br />If the project was -delayed in starting, he said he would have to make <br />interest payments with no way to create revenue to cover this expense. <br />There was a brief discussion on the policy of making adequacy payments <br />when the final plat is filed. <br />Commissioner Privette seconded the motion. <br />Commissioner Juba asked if the Board wanted to give consideration to <br />the offer the Developer had just presented to the Board. <br />Commissioner Mynatt clarified that the developer was willing to pay for <br />30 lots in advance of developing 15 lots in 2008 and 2009. <br />The MOTION failed with Commissioner Privette voting for and Chairman <br />Carruth, Vice Chairman Juba and Commissioners Mynatt and White voting <br />against. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt with <br />Chairman Carruth, Vice Chairman Juba, Commissioner Mynatt and Commissioner <br />White voting for and Commissioner Privette voting against, the Board approved <br />the Consent Agreement between Cabarrus County and Triune Development, LLC for <br />the Castlebrooke Manor Subdivision, including the payment of $9,039.00 per <br />lot to advance school adequacy to be due at final platting, and a revised <br />build-out schedule of no more than 27 lots in 2007, no more than 15 lots in <br />2008, no more than 15 lots in 2009 and no more than 13 lots in 2010. <br />Further, the Board authorized County Manager to execute the agreement on <br />behalf of Cabarrus County. <br />(G-4) Consent Agreement for the Landon Townhome Subdivision Proieat <br />Kassie Goodson Watts, Planner, presented a Consent Agreement for the <br />Landon Townhome Subdivision, developed by Primestar Properties and consists <br />of 109 multi-family townhome lots on +/- 21.1 acres on NC Highway 49 in <br />Harrisburg. She reported the Harrisburg Planning and Zoning Board approved <br />the development on November 21, 2006; however, due to construction delays on <br />Highway 49, the developer was unable to start the project and received a <br />second preliminary plat approval. The Consent Agreement also included a <br />payment of $1, 331.00 per lot to advance school adequacy to be due at final <br />platting and the following build-out schedule: no more than 37 lots platted <br />in 2007, no more than 35 lots platted in 2008 and 37 lots platted in 2009. <br />Commissioner Mynatt asked which high school these students will attend. <br />Jonathan Marshall, Commerce Director, reported he conferred with Robert <br />Kluttz, Cabarrus County Schools, and the students will attend the Hickory <br />Ridge High School. <br />There was a brief discussion on school capacity. It was noted that (1) <br />including previously approved subdivisions, these schools will be functioning <br />at the following capacities upon completion of the Landon Townhome <br />Subdivision project: Pitts School Road Elementary - 103.36 percent, J.N. <br />Fries Middle School - 126.28 percent, and Jay M. Robinson High School - <br />131.49 percent; (2) Hickory Ridge High School is projected to open in August <br />2007 and will provide relief for Jay M. Robinson High School; and (3) <br />although funding has not been identified, a middle school has been included <br />in the Revised Critical Facility Projects for 2009. <br />
