<br />May 23, 2005 - Regular Meeting <br /> <br />Page <br /> <br />171 <br /> <br />(5) Add the following terms to the refund policy for advance payment <br />of park/program participation fees: <br />[a] Park reservations cancelled more than 30 days in advance <br />are eligible for a refund less 25 percent processing fee; <br />[b] If reservations are cancelled less than 30 days in advance, <br />there is no refund but may be rescheduled; and <br />[c] If cancelled due to inclement weather, groups will be <br />allowed up to one year to reschedule; however, the group <br />must notify staff within three working days for <br />rescheduling purposes. <br />(6) Eliminate concession stand operations to athletic tournament <br />groups and organizations. <br />(7) Implement a $20.00 fee for the use of field drag, marker and <br />marking dust for the softball complex at Frank Liske Park. <br /> <br />UPON MOTION of Commissioner Privette, seconded by vice Chairman Carruth <br />and unanimously carried, the Board approved the FY 2005 2006 Fees and <br />Charges Policy for the Cabarrus County Parks and Recreation Department as set <br />forth in the Agenda. The Fees and Charges Policy is on file in the office of <br />the County Manager. <br /> <br />(F-ll) Register of Deeds - Refund of Excise Stamp in the Amount of $140 to <br />Zielinski, Inc. <br /> <br />Pursuant to GS 105-228.37, Horack Talley Pharr & Lowndes, PA, requested <br />a refund of $140.00, payable to the paralegal firm of Zielinski, Inc. The <br />attorney had prepared a deed showing an incorrect amount of $280.00 in excise <br />stamps rather than the correct amount of $140.00. The paralegal incorrectly <br />advanced $140.00 at the time of recording. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board approved the refund of excise stamps in <br />the amount of $140.00 payable to Zielinski, Inc., pursuant to GS 105-228.37. <br /> <br />(F-12) Resolution Authorizing the Disposition of Surplus Property Held by <br />the Transportation Department <br /> <br />There are approximately 16 vans held in inventory by the Transportation <br />Department that have been determined to have fulfilled their usefulness to <br />Cabarrus County. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br />Resolution No. 2005-16 <br /> <br />STATE OF NORTH CAROLINA <br /> <br />RESOLUTION <br /> <br />CABARRUS COUNTY <br /> <br />WHEREAS, General Statute 160A, Article 12 sets <br />requirements for counties in selling and disposing of <br />include private negotiation and sale, sale by sealed <br />bids, and exchanges; and <br /> <br />forth procedures and <br />property. Procedures <br />bids, auction, upset <br /> <br />WHEREAS, this Board desires to dispose of the equipment on the attached <br />listing shown as "Exhibit AU. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Cabarrus <br />County as follows: <br /> <br />That in accordance with the provisions of General Statute 160A-267, <br />this Board authorizes the Transportation Director and the County Purchasing <br />Agent to dispose of the equipment on the attached listing at Public Auction <br />to be held on a date and time to be determined; or, by donation to various <br />non-profit agencies making requests, whichever occurs first. <br /> <br />Adopted this 23m day of May 2005. <br /> <br />/s/ Carolyn B.
