<br />August 8, 2005 - Work Session / Recessed Meeting <br /> <br />Page <br /> <br />287 <br /> <br />Presentation - Residents of Historic Concord <br /> <br />John Day, County Manager, reported Heath Ritchie, President of the <br />Residents of Historic Concord, had asked to make a presentation concerning <br />preservation of the old Tribune Building at the August 15th regular meeting. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Juba and <br />unanimously carried, the Board agreed to place a presentation by Heath <br />Ritchie, Residents of Historic Concord, concerning the old Tribune Building <br />on the Agenda for the August 15th regular meeting as a New Business item. <br /> <br />Change of Meeting Date - September Work Session <br /> <br />Commissioner Privette reported he would be out <br />regularly scheduled Agenda Work Session for September. <br />schedules, Board Members agreed to hold the Agenda Work <br />september 1, 2005, at 3:30 p.m. <br /> <br />of town during the <br />After checking their <br />Session on Thursday, <br /> <br />Closed Session <br /> <br />UPON MOTION Vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to go into Closed Session to consult <br />with the Attorney to preserve the attorney-client privilege, to discuss <br />pending or threatened litigation and the acquisition of property located on <br />Corban Avenue as authorized by NCGS 143-318.11(a) (3) (5). <br /> <br />UPON MOTION of vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of Closed Session. <br /> <br />Condemnation of Property <br /> <br />UPON MOTON of Vice Chairman Carruth, seconded by Chairman Carpenter and <br />unanimously carried, the Board adopted the following Resolution regarding the <br />McCrimmon, sides Realty and Lockavitch properties. <br /> <br />Resolution No. 2005-22 <br /> <br />A RESOLUTION AUTHORIZING CONDEMNATION <br />TO ACQUIRE CERTAIN PROPERTY <br /> <br />WHEREAS, the Cabarrus County Board of Commissioners (the ~Board") <br />hereby determines that it is both necessary and in the public interest to <br />acquire certain property which may be owned by those persons or entities <br />identified in Exhibit A hereto (the "Properties"), for the following purpose: <br /> <br />To expand necessary temporary and permanent jail facilities for <br />the detention of individuals awaiting trial in the Courts of the <br />County and for related law enforcement and/or Court facilities. <br /> <br />WHEREAS, the proper officials or representatives of the Board have been <br />unable to acquire the needed interests in the properties by negotiated <br />conveyance. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD OF <br />COMMISSIONERS that: <br /> <br /> <br />1. The Cabarrus County Board of Commissioners shall acquire by <br />condemnation, for the purposes stated above, the properties and interests <br />therein described in Exhibit A attached hereto and incorporated herein by <br />reference. <br /> <br />2.
