<br />September 29, 2005 - Recessed Meeting. <br /> <br />Page <br /> <br />344 <br /> <br />UPON MOTION of Commissioner Juba, seconded by Vice Chairman Carruth <br />with Commissioner Juba, Vice Chairman Carruth and Chairman Carpenter voting <br />for and Commissioners Privette and Freeman voting against, the Board approved <br />the Pelham poiute Subdivision contingent upon the following conditions <br />outlined by Jonathan Marshall: <br /> <br /> <br />1) That the developer enters into a consent agreement with the County <br />to meet the Adequate Public Facilities Ordinance requirements for <br />school facilities. <br />2) In accordance with the Cluster Development Standards, open space <br />areas shall remain undisturbed except for the installation of active <br />recreation amenities, utility lines, and removal of under brush. <br />Disturbance shall be approved by the Subdivision and/or zoning <br />Administrator. Where buffer areas along roadways lack natural <br />vegetation, developer shall be responsible for planting those areas <br />per the Cabarrus County zoning Ordinance standards. <br />3) A final driveway permit be obtained from N. C. Department of <br />Transportation (NCDOT) standards. <br />4) That all offsite road improvements be constructed per NCDOT <br />standards and be completed prior to the first final plat being <br />approved. <br />5) Existing on-site waste water systems and wells shall be abandoned <br />per state and local requirements. <br />6) That the developer meet Kananpolis requirements for water and sewer <br />service. <br /> <br />The Board was then <br />Pelham pointe Subdivision. <br />years 2006, 2007 and 2008. <br /> <br />asked to consider the Consent Agreement for the <br />The projected schedule reflected 38 lots in the <br /> <br />Chairman Carpenter proposed that the build out schedule begin in 2007 <br />rather than 2006. <br /> <br />Mr. Day asked Danny Bost, the developer of Pelham pointe, if he would <br />be willing to rearrange the build out schedule to move everything out one <br />year to 2007. <br /> <br />Danny Bast questioned the status of subdivisions with lots adjacent to <br />his development. <br /> <br />Mr. Marshall reviewed pending subdivisions and the build out schedule <br />for those developments. <br /> <br />Mr. Bost asked the Board to consider allowing one-half the number of <br />lots in 2007 and one-half in 2008 in order to reduce development costs. <br /> <br />There was brief discussion regarding the proposed phasing and the issue <br />of school adequacy. Mr. Marshall confirmed the revised build out schedule as <br />proposed by Mr. Bost would result in a positive number of school seats for <br />2007. <br /> <br />Commissioner Privette made a motion, seconded by Commissioner Freeman, <br />that the Board approve the Consent Agreement on the condition that a member <br />of the administration of the Cabarrus School Board appear before the Board <br />and state there will be adequate school facilities for these students.
