<br />November 7, 2005 - Recessed Meeting/Work Session <br /> <br />Page <br /> <br />385 <br /> <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session/work session in the Multipurpose Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, November 7, 2005, <br />at 3:30 p.m. <br /> <br />Present - Chairman: Carolyn B. Carpenter <br />Vice Chairman: Robert W. Carruth <br />Commissioners: Robert M. Freeman <br />Joni D. Juba <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager i <br />Jr., County Attorney; Frankie F. Bonds, Clerk to <br />Honeycutt, Deputy Clerk to the Board. <br /> <br />Fletcher L. <br />the Board; <br /> <br />Hartsell, <br />and Kay <br /> <br />Chairman Carpenter called the meeting to order at 3: 32 p.m. Mr. <br />Hartsell was not present for the beginning of the meeting. <br /> <br />Commissioner Juba gave the invocation. <br /> <br />Additions to the Agenda <br /> <br />UPON MOTXON of Vice Chairman Carruth, seconded by Commissioner Juba and <br />unanimously carried, the Board added the following items to the Agenda of the <br />recessed meeting: (1) Closed Session to consult with an attorney in order to <br />preserve the attorney-client privilege and to discuss pending or threatened <br />litigation as authorized by N. C. General Statute 143-318.11(a) (3)and to <br />discuss a personnel matter as authorized by NCGS 143-318.11 (a) (6); and (2) <br />Wellington Chase Subdivision Ratification of Settlement and Order; <br />Approval of Consent Agreement and Plat. <br /> <br />Closed Session <br /> <br />UPON MOTION of <br />unanimously carried, <br />with an attorney in <br />discuss pending or <br />318.11(a) (3) and to <br />318.11 (a) (6) . <br /> <br />Vice Chairman Carruth, seconded by Commissioner Juba and <br />the Board moved to go into Closed Session to consult <br />order to preserve the attorney-client privilege and to <br />threatened litigation as authorized by NCGS 143- <br />discuss a personnel matter as authorized by NCGS 143- <br /> <br />UPON MOTXON of Vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />Open Session <br /> <br />The Board resumed the recessed meeting/work session in the Multipurpose <br />Room at 5:50 p.m. The County Attorney joined the Board at that time and was <br />present for the remainder of the meeting. <br /> <br />Personnel Matter <br /> <br />UPON MOTXON of Vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board granted authority to the Social Services <br />Director to hire an Attorney at a salary up to Level 41 to fill an Attorney I <br />position at the Department of Social Services. <br /> <br />Wellington Chase Subdivision - Ratification of Settlement and Order; Approval <br />of Consent Agreement and Plat <br /> <br />Fletcher L. Hartsell, Jr., County Attorney, stated the Board had <br />authorized the settlement of the lawsuit with Parker and Orleans on September <br />29, 2005. He briefly discussed the mechanics of the Consent Order in the case <br />of Parker and Orleans Homebuilders, Inc., and Shiloh Farms, Inc., versus <br />Cabarrus County along with the Consent Agreement for the Wellington Chase <br />Subdivision. Mr. Hartsell explained the Consent Order resolved all matters in <br />controversy between the plaintiffs and the County and provided for a phased <br />development of the Wellington Chase Subdivision over a five-year period. He <br />reported the Consent Agreement, which was identified in the Consent Order, <br />was consistent with the agreements approved with other entities on September <br />29 and included a phasing requirement. <br /> <br />There was brief discussion regarding road improvements and the schedule <br />for the construction of the Odell replacement school. <br />
