<br />November 21, 2005 (Regular Meeting) <br /> <br />Page <br /> <br />407 <br /> <br />2005 stating that the Midland Volunteer Fire Department would hold a public <br />hearing on behalf of Cabarrus County, North Carolina on September 22, 2005 on <br />the proposed Loan and the Project (the "Notice"). The Midland Volunteer Fire <br />Department held a public hearing during which anyone who wished to be heard <br />on the advisability of the Loan and the Project could speak and there were no <br />written comments about the proposed Project or the Loan received prior to the <br />public haring held by the Midland Volunteer Fire Department. After the <br />Midland Volunteer Fire Department heard from all persons who requested to be <br />heard, the Board of Directors for the Midland Volunteer Fire Department <br />passed the resolution approving the incurrence by the Midland Volunteer Fire <br />Department of up to $328,358.00 in indebtedness from First Charter Bank to <br />finance the acquisition of the project. <br /> <br />The Chairman introduced the following resolution which was read at <br />length: <br /> <br />Resolution No. 2005-29 <br /> <br />RESOLUTION APPROVING THE INCURRENCE BY THE <br />MIDLAND VOLUNTEER FIRE DEPARTMENT OF UP TO $328,358.00 <br />IN INDEBTEDNESS FROM FIRST CHARTER BANK <br />TO FINANCE THE ACQUISITION OF A FIRE TRUCK. <br /> <br />WHEREAS, the Board of Directors of the Midland Volunteer <br />Department on behalf of the Board, pursuant to public notice duly given <br />\\Notice") I held a public hearing on the proposed Loan and proj ect <br />considered the comments of persons who requested to be heard; and <br /> <br />Fire <br />(the <br />and <br /> <br />WHEREAS, neither the County nor any agency thereof shall be liable in <br />any event for the repayment of the Loan, the Loan does not constitute an <br />indebtedness of the County or any agency thereof and does not constitute or <br />create in any manner a debt or liability of the County or any agency thereof; <br />and <br /> <br />WHEREAS, the Board desires to approve the Loan and approve the Project; <br />NOW, THEREFORE, <br /> <br />BE IT RESOLVED by the Board of Commissioners of Cabarrus County, North <br />Carolina as follows: <br /> <br />(1) The publication of the Notice and the designation of the meeting <br />held by the Midland Volunteer Fire Department Board of Directors on September <br />22, 2005 as a public hearing on the Loan and the Project is hereby ratified <br />and approved. <br /> <br />(2) The incurrence by Midland Volunteer <br />indebtedness of up to $328,358.00 to First Charter <br />Project is hereby approved. <br /> <br />Fire <br />Bank <br /> <br />Department <br />to finance <br /> <br />of <br />the <br /> <br />(3) The Project is hereby approved. <br /> <br />(4) All actions heretofore taken and taken in the future by the <br />officers or other representatives of the Midland Volunteer Fire Department or <br />the County of Cabarrus, North Carolina on behalf of Midland Volunteer Fire <br />Department in connection with the Project, including the execution of a Loan <br />and Security Agreement, a Promissory Note and an MVR-G, be, and hereby are, <br />ratified, approved and confirmed in all respects <br /> <br />(5) This resolution shall take effect immediately upon its passage. <br /> <br />Commissioner Privette moved the passage of the foregoing resolution and <br />the resolution passed by the following vote: <br /> <br />AYES: Chairman Carpenter, Vice Chairman Carruth, and Commissioners <br />Freeman, Juba and Privette. <br /> <br />NAYS: <br /> <br />None. <br /> <br />(G) NEW BUSINESS <br /> <br />(G-l) Voluntary Agricultural District Ordinance - Public Hearing <br /> <br />Debbie Bost, County Extension Director, reviewed the Voluntary and <br />Enhanced Voluntary Agricultural District Ordinance along with the differences <br />in a voluntary and an enhanced voluntary district. She reviewed the location <br />of the Northwest, Eastern Cabarrus and Midland areas in which agricultural <br />districts may be designated. Also, she explained the protections that the <br />
