<br />December 19, 2005 - Regular Meeting <br /> <br />Page <br /> <br />444 <br /> <br />(G-6) Cabarrus County Hazardous Materials Response Plan <br /> <br />The Board received the Cabarrus County Hazardous Materials Incident <br />Response plan which is a requirement for the County Local Emergency Planning <br />Committee (LEPC). The proposed plan meets the County's responsibility under <br />the provisions of section 303 (a) of the Emergency Planning and Community <br />Right to Know Act of 1988. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved the cabarrus County Hazardous <br />Materials Response Plan as included in the Agenda. <br /> <br />The Hazardous Material Response Plan as approved is on file in the <br />County Manager's Office. <br /> <br />(G-7) Resolution Authorizing the Disposition of Surplus Elections Equipment <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board adopted the following resolution: <br /> <br />Resolution No. 2005-32 <br /> <br />STATE OF NORTH CAROLINA <br /> <br />RESOLUTION <br /> <br />CABARRUS COUNTY <br /> <br />WHEREAS, General Statute 143-129.7 sets forth procedures and <br />requirements for counties in disposing of property by trade-in; and <br /> <br />WHEREAS, General Statute 160A, Article 12 sets forth procedures and <br />requirements for counties in selling and disposing of property. Procedures <br />include private negotiation and sale, sale by sealed bids, auction, upset <br />bids, and exchanges; and <br /> <br />WHEREAS, this Board desires to dispose of the equipment on the attached <br />listing shown as "Exhibit AU. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Cabarrus <br />County as follows: <br /> <br />That in accordance with the provisions of General Assembly 160A-267, <br />this Board authorizes the County Purchasing Agent to dispose of the equipment <br />on the attached listing by trade-in; or, by donation to various non-profit <br />agencies making requests; or, by private negotiation and sale, whichever <br />occurs first. <br /> <br />Adopted this 19th day of December 2005. <br /> <br />/s/ Robert W.
