<br />December 19, 2005 - Regular Meeting <br /> <br />Page <br /> <br />435 <br /> <br />Submitted To: Board of Commissioners of Cabarrus County, City <br />Council of the City of Concord, Planning and Zoning Commission of <br />the City of Concord <br /> <br />Subject: Cabarrus County Public Safety Center and Jail Annex <br /> <br />Proposed By: The Board of Directors of the Residents of Historic <br />Concord <br /> <br />WHEREAS, the Board of Directors of the Residents of Historic <br />Concord (the Residents) approved and published a Resolution on or <br />about August 19th 2002 expressing their support for a Cabarrus <br />County Public Safety Center and Jail Annex (the Jail); and <br /> <br />WHEREAS, the resolution was submitted to the <br />Commissioners of Cabarrus County (the county); and <br /> <br />Board of <br /> <br />WHEREAS, the County characterize <br />resolution as evidence of strong <br />current plans for the Jail; and <br /> <br />and cite the Residents <br />community support for <br /> <br />2002 <br />their <br /> <br />WHEREAS, the conceptual <br />Residents in 2002 have <br />planning process; and <br /> <br />designs <br />changed <br /> <br />of the Jail <br />significantly <br /> <br />shared wi th <br />throughout <br /> <br />the <br />the <br /> <br />WHEREAS, the current plans for the Jail call for the development <br />of, at least one, and potentially two, inmate housing facilities <br />capable of housing between 400 to 500 hundred persons each; and <br /> <br />WHEREAS, these inmate housing units would be sited within an <br />otherwise predominately residential neighborhood; and <br /> <br />WHEREAS, the Residents previously voiced their views and beliefs <br />by stating: <br /> <br />"The Residents believe that a new jail facility can be located <br />within the downtown region of Concord, while remaining faithful <br />to the design character and purpose of the City of Concord's <br />Downtown Master Plan." (ref: Attachment ~A") and; <br /> <br />WHEREAS, the Residents in August 2002 resolved the following: <br /> <br />~The Residents of Historic Concord urge the County Commissioners <br />to insist that county planning and management staff work closely <br />with the City of Concord's planning staff to achieve a design <br />that enhances the character of Classic-Historic Concord, and in a <br />location that is compatible with the downtown master plan." (ref: <br />Attachment "An) and; <br /> <br /> <br />WHEREAS, the Residents have concluded that government agencies <br />and representatives involved in the Jail project have <br />misinterpreted and are misrepresenting the Residents 2002 <br />resolution: <br /> <br />THEREFORE, be it resolved by the Residents of Historic Concord <br />that: <br /> <br />I. The Jail as currently envisioned DOES NOT remain faithful <br />to the design character and purpose of the City of <br />Concord's Downtown Master Plan (ref: Attachment "A"); and <br />that <br /> <br />II. The Residents are NOT opposed to the construction of a Law <br />Enforcement Center and Jail Annex, as originally proposed <br />in 2002; and that <br /> <br />III. The Residents unanimously support the construction of a Law <br />Enforcement Center and Jail Annex that conforms to the <br />relative dimensions and size illustrated in, and reflected <br />by, the attached revised City of Concord's Downtown Master <br />plan (ref: Attachment "B", items 1 & 2); and that <br /> <br />IV. The Residents urge the County to proceed with the <br />development of these two facilities; and that <br /> <br />V. The Residents insist that the County cease and desist from <br />their use of the Residents' 2002 resolution as evidence of <br />community support for the current Jail plan; and that <br />
