July 26, 2004 Page 561 (C-4) Recognition of Larr~ Na~lor on his Retirement from ~eneral Services John Page, General Services Director, on behalf of the Board of Commissioners, presented a plaque to Larry Naylor in recognition of his retirement. He expressed appreciation for Mr. Naylor's dedication, loyalty and professionalism during his 14 years of service with Cabarrus County. Mr. Naylor accepted the plaque and expressed appreciation for his employment with Cabarrus County. (D) INFORMAL PUBLIC COMMENTS At 7:08 p.m., Acting Chairman Carruth opened the meeting for Informal Public Comments. He stated each speaker would be limited to three minutes. Harold Smith of Kannapolis asked the County Manager to report the actual year-end balance of fund balance at the August meeting as well as explain the difference between fund balance and undesignated fund balance. Further, Mr. Smith reported $1,051,000.00 had been paid to Hartsell & Williams, P.A. from July 1998 to June 1, 2004. He supported the Board's decision to hire in-house legal counsel, stating in his opinion it would be a better use of taxpayers' money. Mr. Day reported the last sales tax revenue for FY 2004 would not be available until September 15, 2004. Jerry Williamson of Concord objected to the amount of attorney fees paid to Attorney Fletcher Hartsell and to his alleged $250.00 per hour billing fee. He further alleged a mistake by Mr. Hartsell had cost the County $130,000.00 and asked the County Attorney to file the necessary paperwork to recoup that money and make a report at the Board's next meeting. Also, Mr. Williamson objected to the School Board's continued operation of the Glenn Center and to the amount of the County School Superintendent's salary. Finally, he stated in his opinion the Board should use taxpayer's money wisely. Marilyn Porter, County Attorney, stated Mr. Hartsell's billing rate was $195.00 per hour, not $250.00. Phyllis Peeler with the Believers Gospel Ministry commended Cabarrus CARES, a group who donates dog and cat food to low-income families. She stated without the organization's support, many animals would die. Further, she stated financial support was needed for the spay/neuter clinic. There was no one else to address the Board; therefore, Acting Chairman Carruth closed that part of the meeting. (E) OLD BUSI~FESS None. (F) CONSENT AGENDA Commissioner Carpenter asked that Item F-11 (Selection of Stark Associates as HOME Program Administrator) be removed from the Consent Agenda for discussion. (F-l) Tax Release and Refund Re~ort - June 2004 UPON MOTION of Commissioner Carpenter, seconded by Acting Chairman Carruth and unanimously carried, the Board approved the June 2004 Release - Refund Report as submitted by J. Brent Weisner, Tax Administrator, and authorized the Tax Collector to process the refunds and releases.
