A public hearing will be held at <br />a later date. <br /> <br />(G-3) Exchange of County-Owned Property Located off Cabarrus Avenue with <br />Carpenter Investments <br /> <br /> Jonathan Marshall, Commerce Director, advised that County staff has <br />been working with Jeff Carpenter of Carpenter Investments to clear up some <br />property line issues for property located off Cabarrus Avenue. A small radio <br />tower that is controlled from the office building owned by Carpenter <br />Investments is located on County property and should have been in the acreage <br />originally deeded with the office building. General Statute 153A-176 (with <br />direct reference to GS 160A-271) permits this type of property exchange. <br /> <br /> The Public Notice stating the Board's intent to consider a resolution <br />for an equal exchange of property at its September 20tn meeting was published <br />in THE INDEPENDENT TRIBUNE on September 10, 2004. <br /> <br /> Commissioner Carpenter stated for the record that she and Jeff <br />Carpenter are not related. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the following Resolution and <br />authorized the County Manager to sign all transfer documents related to the <br />exchange of property with Carpenter Investments. <br /> <br /> Resolution No. 2004-34 <br /> RESOLUTION AUTHORIZING <br /> CARPENTER INVESTMENT PROPERTY EXCH~/qGE <br /> <br /> WHEREAS, Cabarrus County owns property off Cabarrus Avenue that is part <br />of the former fairgrounds, and; <br /> <br /> WHEREAS, Carpenter Investment owns property off Cabarrus Avenue <br />adjacent to that land owned by Cabarrus County, and; <br /> <br /> WHEREAS, Carpenter Investment has agreed to an equal exchange of <br />approximately .032 acre (County Parcel Identification Number 5620-02-8802) <br />for approximately .032 acre (County Parcel Identification Number 5620-02- <br />9453) property with Cabarrus County, and; <br /> <br /> WHEREAS, the property owned by Carpenter Investment and that owned by <br />Cabarrus County are of equal monetary value, and; <br /> <br /> WHEREAS, the property that Carpenter Investment would transfer to <br />Cabarrus County is of equal or greater value to the County as an addition to <br />parcels the County is currently marketing, and; <br /> <br /> WHEREAS, the County may exchange real property belonging to the County <br />for other real property by private negotiation if the County receives full <br />and fair consideration in exchange, and; <br /> <br /> WHEREAS, a notice of the Board's intent to <br />authorizing the Exchange was published in THE <br />September 10, 2004, and; <br /> <br /> consider a resolution <br />INDEPENDENT TRIBUNE on <br /> <br /> WHEREAS, no one has objected to the Exchange in advance of the regular <br />meeting of the Board of Commissioners scheduled for 6:30 p.m. on September <br />20, 2004. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Cabarrus County Board of <br />Commissioners agrees to the transfer of County property to Carpenter <br />Investment in exchange for an equal amount of property and authorizes the <br />County Manager to sign all transfer documents related to this exchange of <br />property. <br /> <br />Adopted this the 20tn day of September, 2004. <br /> <br />/s/ Robert M.
