<br />Organizational Meeting - December 6, 2004 <br /> <br />Page <br /> <br />9 <br /> <br />vice Chairman Carruth made a motion, seconded by Commissioner Juba, to <br />adopt the Memoranda with the City of Kannapolis and the Town of Harrisburg <br />along with the Memorandum with the City of Concord. <br /> <br />There was additional discussion regarding the drafting of the <br />Memoranda, specifically the involvement of the County Attorney and changes <br />that had been made to the document. Mr. Day clarified that the consulting <br />attorney had drafted the document. <br /> <br />Martin Reidinger addressed the Board from the audience. He stated he <br />was not sure which document the Board had before it for consideration, but <br />the draft given to him by Mr. Day that afternoon was not the one that he and <br />Ms. Porter prepared. However, Mr. Reidinger said there were some points <br />included in the document that he and Ms. Porter had suggested. <br /> <br />Chairman Carpenter called for a vote on Vice Chairman Carruth's motion. <br /> <br />The motion to adopt the following <br />and the Town of Harrisburg along with <br />the ci ty of Concord carried with vice <br />and Commissioner Juba voting for and <br />voting against. <br /> <br />Memoranda with the City of Kannapolis <br />the Memorandum of Understanding with <br />Chairman Carruth, Chairman Carpenter <br />Commissioners Freeman and Privette <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />MEMORANDUM OF <br />UNDERSTANDING <br /> <br />THIS MEMORANDUM OF UNDERSTANDING is made and entered into on this, the date <br />shown at the conclusion of this document by and between Cabarrus County, a <br />body politic and corporate of the State of North Carolina ("County") and the <br />City of Kannapolis, a North Carolina municipal corporation ("City"). <br /> <br />WHEREAS, County is experiencing explosive residential growth, particularly in <br />the northwestern portion of county, and <br /> <br />WHEREAS, it is in the long-term interests of all the citizens of County and <br />City to have a synchronized, progressive, cooperative and comprehensive <br />approach to land use and growth management; <br /> <br />NOW THEREFORE, City and County hereby agree as follows: <br /> <br />1) City and County shall endeavor to develop a comprehensive land <br />use/growth management plan, along with the City of Concord, for Northwest <br />Cabarrus County (defined below), using the Highway 73 Corridor Study as a <br />basis. Planning will begin immediately and is to be completed and <br />implemented, including adoption of any desirable ordinances, within six <br />months. Northwest Cabarrus County is the unincorporated portions of Cabarrus <br />County being those portions of Townships 2, 3 and 4 located north of 1-85. <br /> <br />2) County will immediately institute the process required to impose a <br />moratorium on the approval of residential subdivision applications in the <br />unincorporated areas of the county. The moratorium shall have a duration of <br />6 months. During the moratorium, County shall prepare new development and <br />zoning ordinances substantially similar to those in use in Mt. Pleasant, <br />Harrisburg, Concord and Kannapolis. These new ordinances shall be adopted at <br />or before the end of the moratorium. <br /> <br />3) All residential developments submitting preliminary applications <br />to City or preliminary subdivision plats to County prior to the enactment of <br />the moratorium shall be permitted to proceed to approval through the <br />development review process under the ordinances and regulations in effect at <br />the date of execution of this Memorandum. Nothing in this document shall be <br />construed to relate to or affect commercial or industrial development. <br /> <br />4) City hereby endorses County's effort to <br />ordinances and will support implementation thereof. <br /> <br />revise <br /> <br />its <br /> <br />development <br /> <br />5) County hereby endorses City's efforts to secure legislation by the <br />North Carolina General Assembly that would permit City to voluntarily annex <br />property located within the Kannapolis Annexation Area pursuant to the <br />Annexation Agreement executed between City and the City of Concord. <br />Annexation ordinances, facilitating residential subdivisions, that are <br />adopted during the moratorium shall have an effective date after the <br />moratorium. <br />
