<br />December 20, 2004 - Special Meeting <br /> <br />Page <br /> <br />18 <br /> <br />The Board of Commissioners for the County of Cabarrus met in special <br />session at 12:00 p.m. on Monday, December 20, 2004, in the Commissioners' <br />Meeting Room at the Cabarrus County Governmental Center in Concord, North <br />Carolina. The purpose of the meeting was to appoint a County Attorney <br />pursuant to North Carolina General Statute 153A-114. <br /> <br />Present - <br /> <br />Chairman: Carolyn B. Carpenter <br />Vice Chairman: Robert W. Carruth <br />Commissioners: Robert M. Freeman <br />Joni D. Juba <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager; Frankie F. Bonds, Clerk <br />to the Board; and Kay Honeycutt, Deputy Clerk to the Board. <br /> <br />Chairman Carpenter called the meeting to order at 12:00 p.m. <br /> <br />Commissioner Juba gave the invocation. <br /> <br />Appointment of a County Attorney <br /> <br />Commissioner Juba made the following motion, which was seconded by Vice <br />Chairman Carruth: <br /> <br />To appoint Fletcher Hartsell to the position of County Attorney, <br />pursuant to NCGS 153A-114, for an interim period of six months. <br />In addition to serving as the County's legal advisor, he shall <br />also be charged with assisting the County Manager in a search for <br />a staff attorney, which shall be subject to the general <br />provisions of the County Personnel Ordinance and will report to <br />the County Manager, and with assisting the County Manager and the <br />Board of Commissioners in the search for a permanent retained <br />attorney to serve the Board of Commissioners. <br /> <br />Commissioner Privette cited the following reservations <br />Fletcher Hartsell as Interim County Attorney: (1) pending <br />settlement by the law firm (Hartsell & williams) in regards to <br />before the State Personnel Commission; and (2) the amount <br />previously billed by the law firm. commissioner Freeman <br />concerns. <br /> <br />in appointing <br />request for a <br />a hearing held <br />of legal fees <br />stated similar <br /> <br />After discussion, Chairman Carpenter suggested that Board members could <br />schedule a meeting with Senator Hartsell to discuss the settlement and review <br />the billings. <br /> <br />Commissioner Privette made a substitute motion, seconded by <br />Commissioner Freeman, to defer the appointment of an interim county attorney <br />until the Board could meet with Senator Hartsell and discuss a settlement <br />with the County. The substitute motion failed with Commissioners Freeman and <br />Privette voting for and Chairman Carpenter, vice Chairman Carruth and <br />Commissioner Juba voting against. <br /> <br />Chairman Carpenter <br /> <br />called <br /> <br />for a vote <br /> <br />on <br /> <br />the motion by Commissioner <br /> <br />Juba. <br /> <br />The motion carried with Commissioner Juba, vice Chairman Carruth and <br />Chairman Carpenter voting for and Commissioners Freeman and Privette voting <br />against. <br /> <br /> <br />It was generally agreed that Commissioner Privette could address his <br />concerns with Senator Hartsell at the regular Board meeting beginning at 6:30 <br />p.m. on this date (December 20). <br /> <br />Adjournment <br /> <br />There was no further business to come before the Board, <br />Carpenter adjourned the meeting at 12:14 p.m. <br /> <br />and Chairman <br /> <br />j-~ <br /> <br />j.t3~ <br /> <br />Clerk to the Board <br />
