Bonds, Clerk to the Board <br /> <br />(5) Review of Four Designs for the Construction of the Law Enforcement Center <br />and Have Discussion on Future Downtown Parking Needs <br /> <br />Pete Cayado of Ware Bonsall Architects presented four design options <br />for the Law Enforcement Center. Each scenario included all the same functions <br />and general area requirements for those functions but sited the housing and <br />administration buildings at different locations on Corban Avenue. Mr. Cayado <br />highlighted the pros and cons of each scenario including its effect on <br />surrounding properties and parking areas. He reviewed parking reqqirernents <br />and suggested the possibility of constructing a parking deck at Borne time in <br />the future on the existing gravel lot. <br /> <br />Sheriff Brad Riley stated he preferred Option No. 4 for its <br />functionality. Option NO. 4 located the food preparation area in the housing <br />building and provided for future housing expansion as identified in the 50- <br />year plan. <br /> <br />Chairman Carpenter invited John McCrimmon, property owner, and Gene <br />Ligon, tenant and owner of "My Gym", to address the Board. Both expressed a <br />willingness to work with the County in this process and suggested that <br />trading real estate could be advantageous for all parties. Mr. McCrimmon <br />stated his primary concern was for the welfare of his long-term tenants and <br />asked that information be forwarded as soon as it becomes available. Mr. <br />Ligon stated his personal residence was located 'above his business and that <br />all four design options would put him out of business due to the limited <br />number of remaining parking spaces. Further, Mr. Ligon briefly mentioned <br />there was a party who was interested in constructing a five-story building in <br />downtown Concord that would include a parking deck, offices and condominiums. <br /> <br />Mr. Day advised that public participation was important on a project of <br />this magnitude. It was agreed that all four designs will be available for <br />public comment at an open house to be held at the Governmental Center in <br />early January. The Board will be asked to make a decision after receiving <br />the public's input. <br /> <br />(6) Review of Resolution Adopted in February 1995 Granting Authority to an <br />Appointed Staff Member to Declare Official Intent on Behalf of the County to <br />Reimburse Expenditures with Proceeds of Debt <br /> <br />Ms. Dubois reviewed the purpose and intent of the Resolution that was <br />adopted by the Board of Commissioners on February 6, 1995, to establish a <br />procedure to reimburse expenditures with proceeds of debt. She explained this <br />procedure had been used on several past projects. Also, she reported the <br />Schools are now spending some money up front for soil testing, borings, etc. <br />at new school sites. These funds will be reimbursed when the General <br />Obligation bonds are issued. <br /> <br />UPON MOTION of vice Chairman Carruth, seconded by Commissioner Juba and <br />unanimously carried, the Board ratified and reaffirmed the following <br />Resolution adopted by the Board of Commissioners on February 6, 1995. <br /> <br />RESOLUTION DESIGNATING THE COUNTY MANAGER, <br />FINANCE DIRECTOR, OR ASSISTANT FINANCE DIRECTOR TO <br />DECLARE OFFICIAL INTENT ON BEHALF OF THE COUNTY <br />TO REIMBURSE EXPENDITURES WITH PROCEEDS OF DEBT <br />PURSUANT TO UNITED STATES DEPARTMENT OF TREASURY REGULATIONS <br /> <br />BE IT RESOLVED, by the Board of Commissioners (the "Board") for the <br />County of Cabarrus, North Carolina (the "County"): <br /> <br />Section 1. The Board hereby finds, determines and declares as follows: <br /> <br />(a) Treasury Regulations Section 1.150-2 (the "Regulations"), <br />promulgated by the United States Department of Treasury on June 18,. 1993, <br />prescribes certain specific procedures applicable to certain obligations <br />issued by the County after June 30, 1993, including, without limitation, a <br />requirement that the County timely declare its official intent to reimburse <br />certain expenditures with the proceeds of debt to be issued thereafter by the <br />County. <br />
