Bonds, Clerk to the Board

STAFF ATTORNEY VS. CONTRACT ATTORNEY

Commissioner Privette reported that a number of counties and cities
have in-house attorneys. He stated he had asked for a comparison of staff
and contract attorneys.

Mr. Cummings reviewed a comparison of salaries for attorneys as
prepared by the Institute of Government along with a comparison chart of
legal fees for nearby counties and the cities of Concord and Kannapolis. He
stated that most counties have a combination of staff and contract legal
representation. The legal fees for the County, excluding school capital
project funds, for FY 2002 totaled $176,684.00.

Mr. Hartsell stated that he does about 60 percent of the County's legal
work that is done by his office. Other attorneys in his office do the
remaining work, including contract review and real estate issues.

There was discussion concerning the costs that would be associated with
a full time staff attorney, including salary, benefits and administrative,
secretarial or paralegal assistance.

BUDGET ISSUES - FUND BALANCE RESERVE LEVEL

Ms. Dubois reported that a reduction in the County's policy to maintain
a reserve level of 15 percent would cause a reduction in the County's current
AA bond rating. This would in turn impact the County's borrowing rates as
well as the credit rating of every debt issue in the marketplace and also
make the County's debt instruments difficult to sell in the future.

COUNTY MANAGER POSITION

There was brief discussion regarding the process to fill the County
Manager position. Issues addressed by the Board included advertisement in
publications for various professional organizations, the drafting of an
advertisement, the submission of applications to the County Attorney and the
Board's review of the applications that are received.
