February 17, 2003 Page 47 WHEREAS, Cabarrus County owns certain items of personal property that have become surplus for its current needs: and WHEREAS, North Carolina General Statute 160A-266 permits the County to sell such property by private sale, upon authorization by the Board of Commissioners at a regular meeting and notice to the public; and WHEREAS, the Board of Commissioners is convened in a regular meeting; THEREFORE, THE BOARD OF COMMISSIONERS OF CA~ARRUS COUNTY RESOLVES THAT: 2 o The Board of Commissioners authorizes the County Purchasing Agent to sell by private sale the following items of surplus personal property: (1) Caterpillar Model 826C Landfill Compactor (1) A1-Jon Model A010A Landfill Compactor (1) 1954 Dodge Willys Truck (1) 1977 International Roll-off Truck The Purchasing Agent shall publish a notice summarizing this resolution, and no sale may be executed pursuant to this resolution until at least 10 days after the day the notice is published. BONDS, CLERK TO THE BOARD (E-2) Adoption of Revised Ordinance Re~ulatin~ the Use of Cabarrus County Parks and Recreation Facilities and Adoption of Schedule i (Violations and Fines) to the Ordinance On January 27, 2003, the Board adopted the revised Park and Recreation Facilities Ordinance but deferred adoption of Schedule 1 until the following changes could be made: (1) 50 percent discount on the fines if paid within 14 calendar days; and (2) increase in the Fire Lane Parking violation fine. In making those changes, it was necessary to revise sections of the Ordinance that was adopted on January 27th. UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and unanimously carried, the Board adopted the following Ordinance and Schedule I (Violations and Fines) to the Ordinance. Ordinance No. 2003-03 An Ordinance Regulating The Use Of the Cabarrus County, North Carolina Parks and Recreation Facilities (the "Park" or "Parks") WHEREAS making available recreational opportunities for citizens of all ages is a subject of general interest and concern, the Board of Commissioners for the County of Cabarrus, North Carolina (the "County") therefore declares that the public good and general welfare of the citizens of the County require adequate and safe recreational facilities and it is the policy of the County to encourage, foster and provide these facilities for all of its citizens and to preserve and protect the public safety, peace, health, comfort, enjoyment, and welfare of all persons while within the limits of the Parks. Be it ordained by the County Board of Commissioners ("Board of Commissioners") that the following Chapter 50-1 through 50-18 of the Code of Ordinances, Cabarrus County, North Carolina supercedes and amends in its entirety Chapter 50-1 through 50-18 of the Code of Ordinances, Cabarrus County, North Carolina, adopted on or about January 27, 2003 and the below 50-1 through 50-18 sets forth rules and regulations for the use of and conduct in the County Parks (the "Ordinance") that shall apply to all those who use, visit, or enter the Parks on or after the date of adoption, set forth below. Section 50-1. Construction. In the interpretation of this and all succeeding Parks Ordinances, the provisions shall be construed as follows: 1. Any term in the singular shall include the plural. 2. Any term in the masculine shall include the feminine and neuter.
