Any annual financial information containing modified operating data or financial information shall explain, in narrative form, the reasons for the modification and the impact of the change in the type of operating data or financial information being provided. The provisions of this Section shall terminate upon payment, or provision having been made for payment in a manner consistent with Rule 15c2- 12, in full of the principal of and interest on all of the Bonds. Section 16. The Chairman or Vice-Chairman of the Board, the Clerk to the Board, the County Manager, the Finance Officer and the other officers of the Issuer are each hereby authorized and directed to execute and deliver for and on behalf of the Issuer any and all financing statements, certificates, documents or other papers, including, without limitation, Letter(s) of Representations to Securities Depositories, and to perform any and all acts they may deem necessary or appropriate in order to carry out the intent of this resolution and the matters herein authorized. Section 17. This resolution shall take effect upon its passage. Upon motion of Commissioner Carpenter, seconded by Commissioner Privette, the foregoing resolution entitled: "RESOLUTION PROVIDING FOR THE ISSUANCE OF UP TO $21,725,000 GENERAL OBLIGATION REFUNDING BONDS, SERIES 2003" was passed by the following vote: Ayes: Commissioners Carpenter, Privette and Carruth, Vice Chairman Suggs and Chairman Freeman. Change for Accessory Buildings - Public Hearing - 6:30 p.m. Mr. Rodger Lentz, Planning Manager, presented a proposed amendment to the Cabarrus County Zoning Ordinance to regulate the size and placement of accessory buildings. It will limit the total square footage of all accessory buildings on a lot as a percentage of the total lot area. The Planning and Zoning Commission recommended the approval of the text amendment. At 8:28 p.m., Chairman Freeman opened the public hearing to consider Petition C2003-02(T) to amend the Zoning Ordinance to regulate the size and placement of accessory buildings. The Public Hearing Notice was published in THE INDEPENDENT TRIBUNE on July 10 and 20, 2003. Mr. hon Johansen spoke in support of the proposed amendment, stating the proposed regulations would be fair to everyone. There was no one else who wished to address the Board, and Chairman Freeman closed the public hearing at 8:30 p.m. UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and unanimously carried, the Board adopted the following Ordinance. Ordinance No. 2003-10 Petition C03-02 (T) AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as follows: CHAPTER SEVEN, SECTION 7-4: USES PERMITTED ON STANDARDS (PBS) Add/Change Item 1 as follows: 1. Accessory Buildings and Apartments Zones permitted based on standards Agricultural/open, countryside residential, low density residential, medium density residential, high density residential/mixed use, office/limited commercial, general commercial, limited industrial Accessory buildings on lots less than 2 acres Standards: a) Size of Unit: The total square footage for all accessory building footprints on a lot shall not exceed 3 percent of the total lot area.
