August 25, 2003 Page 233 <br /> <br /> A motion was made by Commissioner Privette, seconded by Vice Chairman <br />Suggs to reject the draft UDO for the County. There was no vote as it was <br />determined that the Board had "tabled" the UDO until October 2003. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board voted to reconsider at its next <br />meeting the tabling motion of the Unified Development Ordinance. <br /> <br />Enforcement of Concord's Development Standards Outside the City Limits <br /> <br /> Vice Chairman Suggs expressed concern that the City of Concord is <br />requiring developers of property located outside the city limits to meet the <br />City's development standards in order for City to provide utilities. He <br />stated this is creating a problem for developers. <br /> <br /> There was discussion regarding the City's enforcement of its <br />development standards outside the city limits, the 1988 Reciprocal Agreement <br />that allows the County to connect to Concord water lines and issues <br />associated with the County's ability to provide water service. It was noted <br />that the Board had discussed this issue previously but had taken no formal <br />action. <br /> <br /> Mr. Jim Scarbrough, Attorney, advised that he has written several <br />letters to the City on behalf of developers regarding development standards <br />and the provision of water service to developments located outside the city <br />limits. <br /> <br /> UPON MOTION of Vice Chairman Suggs, seconded by Commissioner Prlvette <br />and unanimously carried, the Board directed the County Attorney to deliver a <br />letter to the City of Concord describing the County Commissioners' contention <br />that the City Council has no authority to impose its development standards, <br />other than those associated with water and sewer line construction, on <br />projects outside the city limits in exchange for the provision of public <br />utilities. <br /> <br />Closed Session <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to go into Closed Session to discuss <br />matters relating 'to the location or expansion of industries or other <br />businesses in Cabarrus County as authorized by North Carolina General Statute <br />143-318.11 (a) (4). <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />No action was reported from the Closed Session. <br /> <br />Bethel/Pitts School Road Elementar~ Schools <br /> <br /> Mr. Day presented a Memorandum from Steve Little, Director of the Parks <br />and Recreation Department, advising that the gymnasiums for the new Bethel <br />and Pitts School Road Elementary Schools are inadequate in size for <br />recreational basketball practices and games. The architect has estimated the <br />cost to increase the size of the playing courts at $77,600.00 for Pitts <br />Elementary and at $87,600.00 for Bethel Elementary. The Parks and Recreation <br />Commission voted to recommend the changes to Pitts Elementary. However, due <br />to the potential delay in opening Bethel School, the Commission voted to <br />request that the out-of-bound surface be reduced from six feet to four feet <br />at that gymnasium. Mr. Day advised that sufficient funding was included in <br />the financing of the new schools to cover the cost of these changes. <br /> <br /> Board members expressed concern that the school/park concept that has <br />been in place for a number of years was not utilized in planning the new <br />schools. The Board also discussed the possibility for the old Bethel School <br />to continue to be used by the community after the replacement school opens, <br />including the use of the gymnasium and playing fields as well as the possible <br />location for a branch library. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the changes to the gymnasium at <br />the new Pitts School Road Elementary School at an estimated cost of <br />$77,600.00 and requested that the School Board approve the necessary change <br />order for the work. <br /> <br /> <br />
