November ~4, ~0~3 Page 302 <br /> <br />estate and development company) and staff members Mike Downs, Jonathan <br />Marshall and Don Cummings to join the Board for portions of the Closed <br />Session. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board moved to go into Closed Session to discuss <br />a personnel matter as authorized by North Carolina General Statute 143- <br />318.11(a) (6) . <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to come out of the Closed Session. <br /> <br />Activities Related to the Sale of the Former Fairgrounds Property <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Vice-Chairman Suggs <br />with Commissioners Carruth and Privette, Vice Chairman Suggs and Chairman <br />Freeman voting for and Commissioner Carpenter voting against, the Board <br />approved the following December 2003 activities related to the sale of a <br />portion of the former Cabarrus County Fairground parcels: <br /> <br />With Signing of Contracts: <br /> Soil Testing $7,000.00 <br /> Phase One Environmental $2,500.00 <br /> Storm Water Retention <br /> Engineering & Permitting $7,000.00 <br /> Work with City on Sidewalks $0 <br /> Utility Extension <br /> Engineering & Permitting $8,000.00 <br /> Management Fee $4,867.50 <br /> Sub-total <br /> (Addresses minimal environmental issues, and time <br /> critical infrastructure improvements) <br /> <br />$29,367.50 <br /> <br />Amendments to Contract with Mid-State Transport, Inc. <br /> <br /> Mr. Downs reviewed proposed Amendments to the Contract for <br />Transportation Services (07/01/2003) with Mid-State Transport. The proposed <br />Amendments provide for the County to pay the expenses for rent, fuel, etc., <br />for Mid-State Transport and to deduct the cost of those expenses from the <br />"rate per mile" paid to Mid-State. Final action to bring the transportation <br />services in-house will be on the December 15tn Agenda. <br /> <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Suggs <br />with Commissioners Carruth and Privette,' Vice Chairman Suggs and Chairman <br />Freeman voting for and Commissioner Carpenter voting against, the Board <br />approved the Amendments (10/30/03) to the contract (07/01/2003) with Mid- <br />State Transport, Inc. as submitted by Mr. Downs and authorized the County <br />Manager to execute the Amendments on behalf of Cabarrus County. <br /> <br />Personnel Issues <br /> <br /> At the October 27th meeting, the Board authorized a Deputy Clerk <br />position and asked for information regarding the status of Clerk and Deputy <br />Clerk positions in other jurisdictions. <br /> <br /> Mrs. Bonds reported that information was obtained from 16 counties. Of <br />those counties, four Clerks are exempt from the personnel ordinance/policy <br />and all Deputy Clerks are subject to the personnel ordinance/policy. She <br />recommended that the Deputy Clerk position in Cabarrus County be established <br />as a regular County employee and subject to the County's Personnel Ordinance. <br /> <br /> There was brief discussion regarding the appointment process for Clerk <br />and Deputy Clerk positions. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter <br />and unanimously carried, the Board authorized the Clerk to interview and hire <br />a Deputy Clerk who will be subject to the County's Personnel Ordinance. <br /> <br /> Mr. Day reported that Ms. Dubois had resigned as Deputy County Manager <br />for Administration and would retain her position as Finance Director. He <br />proposed the establishment of an Assistant County Manager position to be held <br />by Mr. Downs (Deputy County Manager for Operations) and authorization to hire <br />a Deputy County Manager. <br /> <br /> <br />
