UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Suggs and unanimously carried, the Board moved to come out of the Closed Session. UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs and unanimously carried, the Board moved to go into Closed Session to discuss a personnel matter as authorized by North Carolina General Statute 143- 318.11(a) (6) . UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette and unanimously carried, the Board voted to come out of the Closed Session. Activities Related to the Sale of the Former Fairgrounds Property UPON MOTION of Commissioner Carruth, seconded by Vice-Chairman Suggs with Commissioners Carruth and Privette, Vice Chairman Suggs and Chairman Freeman voting for and Commissioner Carpenter voting against, the Board approved the following December 2003 activities related to the sale of a portion of the former Cabarrus County Fairground parcels: With Signing of Contracts: Soil Testing $7,000.00 Phase One Environmental $2,500.00 Storm Water Retention Engineering & Permitting $7,000.00 Work with City on Sidewalks $0 Utility Extension Engineering & Permitting $8,000.00 Management Fee $4,867.50 Sub-total (Addresses minimal environmental issues, and time critical infrastructure improvements) $29,367.50 Amendments to Contract with Mid-State Transport, Inc. Mr. Downs reviewed proposed Amendments to the Contract for Transportation Services (07/01/2003) with Mid-State Transport. The proposed Amendments provide for the County to pay the expenses for rent, fuel, etc., for Mid-State Transport and to deduct the cost of those expenses from the "rate per mile" paid to Mid-State. Final action to bring the transportation services in-house will be on the December 15tn Agenda. UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Suggs with Commissioners Carruth and Privette,' Vice Chairman Suggs and Chairman Freeman voting for and Commissioner Carpenter voting against, the Board approved the Amendments (10/30/03) to the contract (07/01/2003) with Mid- State Transport, Inc. as submitted by Mr. Downs and authorized the County Manager to execute the Amendments on behalf of Cabarrus County. Personnel Issues At the October 27th meeting, the Board authorized a Deputy Clerk position and asked for information regarding the status of Clerk and Deputy Clerk positions in other jurisdictions. Mrs. Bonds reported that information was obtained from 16 counties. Of those counties, four Clerks are exempt from the personnel ordinance/policy and all Deputy Clerks are subject to the personnel ordinance/policy. She recommended that the Deputy Clerk position in Cabarrus County be established as a regular County employee and subject to the County's Personnel Ordinance. There was brief discussion regarding the appointment process for Clerk and Deputy Clerk positions. UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter and unanimously carried, the Board authorized the Clerk to interview and hire a Deputy Clerk who will be subject to the County's Personnel Ordinance. Mr. Day reported that Ms. Dubois had resigned as Deputy County Manager for Administration and would retain her position as Finance Director. He proposed the establishment of an Assistant County Manager position to be held by Mr. Downs (Deputy County Manager for Operations) and authorization to hire a Deputy County Manager.
