257 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Thursday, January 3, 2002, <br />at 6:30 p.m. The purpose of the meeting was to conduct a Closed Session to <br />consider and give instructions to the County Attorney concerning the handling <br />or settlement of a potential claim, judicial action, or administrative <br />procedure as authorized by North Carolina General Statute 143-318.11(a) (3). <br /> <br />Present - Chairman: Robert M. Freeman <br /> Vice Chairman: Robert W. Carruth <br /> Commissioners: Arne L. Fennel <br /> Coy C. Privette <br /> Richard D. Suggs <br /> <br /> Also present were Frank W. Clifton, Jr., County Manager; Fletcher L. <br />Hartsell, Jr., County Attorney; and Dawn McHale, Tax Administrator. <br /> <br />Mr. Clifton recorded the minutes in the absence of the Clerk. <br /> <br />Chairman Freeman called the meeting to order at 6:30 p.m. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board moved to go into Closed Session to <br />consider and give instructions to the County Attorney concerning the handling <br />or settlement of a potential claim, judicial action, or administrative <br />procedure as authorized by North Carolina General Statute 143-318.11(a) (3). <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board voted to authorize the County Attorney to <br />obtain specialized legal counsel as necessary to respond to and protect the <br />County's claims in the bankruptcy filing made by Pillowtex, Inc., at the <br />court hearing set for January 17, 2002, in Wilmington, Delaware. <br /> <br /> There being no further business to come before the Board, Chairman <br />Freeman adjourned the meeting. <br /> <br />Clerk to the Board <br /> <br /> <br />
