On November 19, 2001, the Board had approved <br />a request by LandCraft for two telephone easements and a~water line easement on <br />property recently dedicated to the County. The second telephone easement was in <br />error and should have been an easement for the gas pipeline. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board granted a utility pipeline easement to Public <br />Service of North Carolina, Inc. as requested by LandCraft Properties to serve the <br />Canterfield Estates Subdivision. The easement will consist of approximately .0264 <br />of an acre and is described as "Easement 2" as shown on a plat of survey by McKim <br />& Creed entitled "Easement Survey for Telephone and Gas Easements for <br />Canterfield, LLC", dated September 26, 2001. Further, the Board authorized the <br />County Manager to execute the Utility Pipeline Easement on behalf of Cabarrus <br />County. <br /> <br />NEW BUSINESS <br /> <br />Appeal of Subdivision Request C02-01(S) Mount 0live Estates and Consideration of <br />Adequate Public Facilities Ordinance Donation <br /> <br /> Ms. Kelly Sifford, Senior Planner, presented Petition C02-01(S), <br />preliminary plat approval for the Mount Olive Estates Subdivision located in <br />Township 7 on Mount Olive Road. The developers (Edward L. Duke and Bryant L. <br />Parnell, Jr.) plan to develop 14 lots on approximately 20.88 acres. The <br />Planning and Zoning Board voted 5-3 in favor of approving the subdivision on its <br />technical merits, but voted 4-3 to deny the subdivision based on its Adequate <br />Public Facilities Ordinance (APFO) inadequacies. As indicated by correspondence <br />dated January 18, 2002, from Sam King, Jr., PE/PLS of King Engineering of <br />Concord, Inc., the developers are appealing the Planning and Zoning Board's <br />denial of the preliminary plat and are pledging $7,000.00 (14 lots @ $500.00) to <br />advance adequacy of public schools in the area affected by the proposed <br />development. <br /> <br /> Commissioner Fennel questioned the size and value of homes to be built in <br />the subdivision. <br /> <br /> Ms. Sifford stated she did not have that information, but advised that the <br />homes would be "stick-built" homes by Duke Builders. Also, she confirmed that <br />the developers would use well and septic facilities in the subdivision. <br /> <br /> Commissioner Privette questioned the location of the proposed subdivision, <br />its school district and the status of school enrollment in that district. <br /> <br /> Ms. Sifford advised that the property is located in the Mt. Pleasant School <br />District and that there are a few seats available in that district. However, she <br />explained the total capacity for the entire system is used in considering APFO <br />issues as school lines are adjusted after development occurs in different areas <br />of the county. According to Ms. Sifford, there are over 7,000 lots approved in <br />Cabarrus County that could be built on tomorrow. However, she indicated that some <br />of these lots (rezonings) have been approved for a number of years. <br /> <br /> <br />
