She gave a brief overview of the <br />program that allows local tax collectors to use taxpayers' State income tax <br />refunds to offset delinquent debts owed to the County. The delinquent debt must <br />be at least $50.00 and at least 60 days delinquent before it can be submitted <br />through a local government clearinghouse to the North Carolina Department of <br />Revenue to be matched against income tax refunds. The cost for participating in <br />the program is $15.00 per match. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board adopted the following Resolution for Cabarrus <br />County to participate in the North Carolina Government Debt Setoff Program and <br />designated Dawn McHale, Tax Administrator, as the person to hold 'hearings and <br />conduct necessary proceedings associated with the program. <br /> <br />Resolution No. 2002-02 <br /> <br />NORTH CAROLINA GOVERNMENT DEBT SETOFF-PROGRAM <br /> <br /> WHEREAS, NCGS Chapter 105A, Setoff Debt Collection Act, authorizes the <br />North Carolina Department of Revenue to cooperate in identifying debtors who owe <br />money to local governments and who qualify for refunds from the Department of <br />Revenue; and <br /> WHEREAS, the law authorizes the setting off of certain debts owed to local <br />governments against tax refunds; and <br /> WHEREAS, the North Carolina Association of County Commissioners and the <br />North Carolina League of Municipalities have jointly established a clearinghouse <br />to submit debts on behalf of Cabarrus County, as provided by law. <br /> NOW, THEREFORE, BE IT RESOLVED by the Cabarrus' County Board of <br />Commissioners that the County will participate in the debt setoff program and <br />hereby designates Dawn McHale, Tax Administrator, as the person to hold hearings <br />and conduct necessary proceedings. <br /> The Chairman and County Manager are hereby authorized to execute such <br />documents and agreements as necessary to participate in the debt setoff program. <br /> Adopted by the Cabarrus County Board of Commissioners on this the 28tn day <br />of January, 2002. <br /> <br />/s/ Robert M.
