March 18, 2002 Page 304 <br /> <br /> Chairman Freeman recognized the second and called for a vote on <br />Commissioner Privette's motion to delay consideration of the naming <br />rights/ticket sales, issues until the April meeting with Mr. Chappuis to <br />obtain ticket sales proposals from Etix.com and other ticket companies for <br />consideration at that time. The motion was approved with Commissioners <br />Privette and Suggs and Chairman Freeman voting for and Vice Chairman Carruth <br />and Commissioner Fennel voting against. <br /> <br />Expo - Agreement with Infinity Broadcasting Corporation <br /> <br /> Mr. Chappuis presented a proposed Sponsorship Agreement with Infinity <br />Radio Holdings, Inc., for the radio stations in that group to participate in <br />Fair events, concerts, etc. at the Expo. In return, Infinity is offering the <br />County a significant amount of promotional announcements/advertising for Expo <br />events as well as some live broadcasts from the Expo Center. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Fennel <br />and unanimously carried, the Board approved the Sponsorship Agreement with <br />Infinity Radio Holdings, Inc. (d/b/a WSOC FM 103.7, SportsRadio 610 WFNZ, <br />WNKS, KISS 95.1 and WSSS, STAR 104.7) with respect to advertising, <br />promotional and sponsorship service for concert events, tradeshows, <br />conventions, etc., scheduled to take place at the Cabarrus Arena and Events <br />Center from September 16, 2002 to December 31, 2003. <br /> <br /> Ms. Chele Fassig, Promotion and Marketing Director at WSOC-FM 103.7, <br />stated the radio stations are very excited to be a part of the Cabarrus Arena <br />and Events Center and are ready to start promoting the facility. <br /> <br />Expo Food and Beverage Proposal <br /> <br /> Mr. Chappuis reviewed the proposed Food and Beverage Policy for the <br />Expo and discussed the impact that the ability to serve alcohol would have on <br />the type of functions booked at the facility. <br /> <br /> Vice Chairman Carruth made a motion to approve the proposed Food and <br />Beverage Proposal as contained in the Agenda [Item D-l(c)]. <br /> <br /> commissioner Fennel seconded Vice Chairman Carruth's motion and asked <br />that the following statement be added as Item D: "Alcohol will be strictly <br />prohibited from any and all County-sponsored events, including the Cabarrus <br />County Fair." <br /> <br /> Vice Chairman Carruth accepted the amendment and added Item D to his <br />motion. <br /> <br /> Commissioner Suggs questioned the issue of liability if there is an <br />alcohol-related accident resulting from someone driving after drinking at the <br />Expo facility. <br /> <br /> Mr. Hartsell addressed issues regarding the "potential" for liability <br />and the "likelihood" of liability. He discussed legal issues associated with <br />the agreement between the County and vendor, specifically the nature and <br />extent of that agreement and the responsibility placed on the vendor. <br /> <br /> Commissioner Privette made a substitute motion to delay the Food and <br />Beverage Proposal until the April meeting with legal counsel to present at <br />that time the legal agreement that the County will be entering into with an <br />outside vendor. Commissioner Suggs seconded the substitute motion. <br /> <br /> Mr. Clifton reported that a vendor had not yet been identified. He <br />stated a policy decision on the ability to provide alcohol as part of the <br />food service is needed before the vendors will develop a proposal. <br /> <br /> Mr. Hartsell advised he could create some parameters for a contract as <br />requested in Commissioner Privette's substitute motion, but could not prepare <br />a specific contract without having a vendor. <br /> <br /> There was lengthy discussion regarding the Food and Beverage Proposal, <br />specifically the serving of alcohol at the Expo. Vice Chairman Carruth and <br />Commissioner Fennel spoke in support of the Proposal and addressed the <br />following issues: (1) impact on facility revenue; (2) the restricted areas at <br />the facility where alcohol could be served; (3) the types of events at which <br />alcohol could be served (i.e., privately sponsored functions such as <br />banquets, etc., where food is served); (4) prohibiting alcohol at any County- <br />sponsored event, including the County Fair, or at ticketed Arena events such <br /> <br /> <br />
