August 19, 2002 Page 422 <br /> <br /> WHEREAS, the Cranston-Gonzalez National Affordable Housing Act of 1990 <br />makes provisions whereby units of general local governments may enter into <br />cooperation agreements and form consortia to undertake or assist in <br />undertaking affordable housing pursuant to the HOME Investment Partnership <br />Program; and <br /> <br /> WHEREAS, the County of Cabarrus, North Carolina, along with other units <br />of general local governments, with the City of Concord as the lead entity, <br />desire to form the Cabarrus/Iredell/Rowan Housing Consortium to undertake or <br />assist in undertaking affordable housing'under the Cranston-Gonzalez National <br />Affordable Housing Act of 1990; and <br /> <br /> WHEREAS, Article 20 of Chapter 160A of the North Carolina General <br />Statutes authorize units of local government to enter into contracts or <br />agreements with each other in order to execute any undertaking; and <br /> <br />NOW, THEREFORE, be it resolved by Cabarrus County that: <br /> <br />1. Cabarrus County hereby supports the continuation of the <br /> Cabarrus/Iredell/Rowan Housing Consortium. The County Manager of <br /> Cabarrus County is authorized to execute an agreement with other <br /> participating units of general purpose local government in <br /> Cabarrus/Iredell/Rowan counties to sustain this Consortium; and <br />2. The County Manager is further authorized to sign all contracts, <br /> grant agreements, including certifications, approved by the County <br /> Attorney, with the Department of Housing and Urban Development, the <br /> State of North Carolina or other agencies as may be required to <br /> carry out activities of the Consortium. <br /> <br /> Adopted this 19th day of August 2002 in a regular session of the Board <br />of Commissioners of Cabarrus County meeting in Concord, North Carolina. <br /> <br />ATTEST: <br />/s/ Frankie F. Freeman, Chair <br /> <br />(E-9) Resolution Authorizing the Transfer of a Surplus 1996 Ford Ambulance to <br />the Cold Water Volunteer Fire Department <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Fennel <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br />STATE OF NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESOLUTION <br /> <br />Resolution No. 2002-30 <br /> <br /> WHEREAS, Cabarrus County has one (1) 1996 Ford E-350 Ambulance Type <br />III, vehicle identification number 1FDKE30F7THA20683; and, <br /> <br /> WHEREAS, this Board desires to dispose of the above referenced <br />equipment; and, <br /> <br /> WHEREAS, North Carolina General Statute 160A, Article 12 sets forth <br />procedures and requirements for counties in selling and disposing of <br />property. Procedures include private negotiation and sale, sale by sealed <br />bids, auction, upset bids, and exchanges; and, <br /> <br /> WHEREAS, North Carolina General Statute 160A-279 provides that any <br />governmental unit may convey personal property to any other entity carrying <br />out a public purpose, without compensation. <br /> <br /> NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Cabarrus <br />County as follows: <br /> <br /> That in accordance with the provisions of General Statute 160A-267, <br />this Board authorizes the County Purchasing Agent to dispose of the above <br />referenced personal property no earlier than ten (10) days after a notice <br />summarizing the contents of the resolution is published once. Also, pursuant <br />to General Statute 160A-279, the aforementioned personal property may be <br />conveyed to the Cold Water Volunteer Fire Department without compensation. <br /> <br /> <br />
