October 21, 2002 Page 475 <br /> <br />Closed Sessions); (2) To Consult with the County Attorney Concerning <br />Threatened or Pending Litigation as Authorized by NCGS 143-318.11(a) (3); (3) <br />To Consider the Acquisition of Real Properties in the Vicinity of Lake Howell <br />as Authorized by NCGS 143-318.11(a) (5); and (4) To Discuss Personnel Matters <br />as Authorized by NCGS 143-318.11(a) (6). <br /> <br /> UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Fennel <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />Approval and Sealing of General Accounts/Minutes of Closed Sessions <br /> <br /> UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board approved and sealed the minutes/general <br />accounts of Closed Sessions held on August 13, August 21 and September 16, <br />2002; and delegated authority to the County Manager and/or County Attorney to <br />unseal the minutes/general accounts of the Closed Sessions as appropriate, <br />pursuant to North Carolina General Statute 143-318.10(e). <br /> <br />Purchase of Property <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board authorized the purchase of 28 ± acres of <br />Patterson property off Highway 73 in the vicinity, of Lake Howell at <br />$20,000.00 per acre and authorized the purchase of a required right-of-way to <br />provide access from the property to Highway 73 from Theresa Eudy at the same <br />per acre price. Further, the Board authorized the appropriate budget <br />amendments for the purchase of the Patterson and Eudy properties. <br /> <br />Condemnation of Property <br /> <br /> UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Fennel <br />and unanimously carried, the Board authorized a resolution to condemn .015 <br />acre of land, located on Harris Road and owned by Johnny's LLC, for $3,500.00 <br />in conjunction with the Cabarrus County Board of Education. The purpose for <br />which the property is to be condemned is to provide a right-of-way for the <br />installation of a gas line to serve the new Harris Road Middle School. <br /> <br />ADJOURNMENT <br /> <br /> There being no further business to come before the Board, Chairman <br />Freeman adjourned the meeting at 12:10 a.m. <br /> <br />Clerk to the Board <br /> <br /> <br />
