32 <br /> <br />the UDO Steering Committee and the municipalities finalize all changes to the <br />UDO prior to the Board voting on the proposed ordinance. The Board took no <br />action concerning Commissioner Privette's proposal. <br /> <br /> Mr. Marshall and Ms. Kelly Sifford, Senior Planner, reviewed the items <br />listed on the ~UDO Master List of Recommended Changes (After Sept. 15, 2000)" <br />and responded to questions by the Board about specific issues on the list. <br />This list included recommended changes for all versions of' the UDO along with <br />recommended changes for the Kannapolis, Concord and Cabarrus County versions. <br />Also, the list highlighted the key items and recommended .changes to be <br />discussed by the Steering Committee. Issues discussed by the Board included <br />the role of the Zoning Administrator, sidewalks, neighborhood meetings, <br />density of the Agriculture (AG) District, home occupations, conditional use <br />rezoning, sign regulations, location of churches, connectivity ratio, etc. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Fennel and <br />unanimously carried, the Board deferred action on the proposed Unified <br />Development Ordinance until the next meeting on March 19, 2001, with <br />recommendations from the Steering Committee and the Town of Harrisburg at <br />that time. <br /> <br />NEW BUSINESS <br /> <br />Amendment to Noise Ordinance Re~ulatin~ Fireworks Displays - Public Hearing - <br />6,~0 p.m. <br /> <br /> At 8:25 P.M., Chairman Fennel opened the public hearing on the proposed <br />revision to the Cabarrus County Noise Ordinane (Article II, Chapter 30 of the <br />Code of Ordinances) to regulate the time of day that fireworks displays are <br />held. <br /> <br /> The Notice of the Public Hearing was published in THE INDEPENDENT <br />TRIBUNE and THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on February 8, 2001. <br /> <br /> There was no present to address the Board, and Chairman Fennel closed <br />the public hearing. <br /> <br /> Chairman Fennel made a motion, seconded by .Vice Chairman Carruth, to <br />adopt the revised Noise Ordinance to include a provision to prohibit the <br />display of fireworks after 9:00 p.m. on Sunday through Thursday and after <br />11:00 p.m. on Friday and Saturday,. with an exception for New Year's Eve, when <br />fireworks may be displayed until 12:45 a.m. on New Year's Day. <br /> <br /> Mr. Joe Schlatter, reporter with THE INDEPENDENT TRIBUNE, questioned <br />the display of fireworks on the Fourth of July. <br /> <br /> UPON AMENDED MOTION of Chairman Fennel, seconded by Commissioner Privette <br />and unanimously carried, the Board agreed to amend the Noise Ordinance to <br />prohibit the display of fireworks after 9:00 p.m. on Sunday through Thursday <br />and after 11:00 p.m. on Friday and Saturday, with an exception for New Year's <br />Eve, when fireworks may be displayed until 12:45 a.m. on New Year's Day and <br />for an exception to permit fireworks to be displayed until 11:00 p.m. on the <br />Fourth of July. The revised Noise Ordinance (Article II, Chapter 30 of the <br />Code of Ordinances) as adopted by the Board is as follows: <br /> <br />Ordinance No. 2001-01 <br /> <br />BE IT ORDAINED that Article II,. Chapter 30 of the Cabarrus County North <br />Carolina Code of Ordinances is amended to read as follows: <br /> <br />ARTICLE II. NOISE <br />Sec. 30-26. Penalty for violation of article. <br />Any person violating the provisions of this article shall be guilty of a <br />misdemeanor and, upon conviction, shall be punished in accordance with <br />section 1-7. <br />(Ord. of 6-7-82, § 2) <br /> <br />Sec. 30-27. Enumeration of prohibited acts. <br />(a) Subject to the provisions of this article, the creation of any <br />unreasonable loud, disturbing and unnecessary noise of such character as <br />would be a detriment to public health, comfort, safety, welfare and <br />prosperity of the residents of the county is prohibited. <br /> <br /> <br />
