<br />between the County and cities; (3) adoption of the UDO by the municipalities,
<br />possibly by some without sufficient review and understanding; (4) the need
<br />for the County to adopt the provisions of the Memorandum of Understanding and
<br />be a part of the continuing dialogue concerning the UDO; and (5) the need to
<br />have quarterly work sessions to review recommended changes to the UDO.

<br /> Commissioner Privette made a motion, seconded by Chairman Fennel, to
<br />table the UDO until April 2002 and to adopt the Memorandum of Understanding
<br />between the County and the local municipalities.
<br />
<br /> Chairman Fennel asked that the motion be amended to include instructions
<br />for staff to incorporate into the draft UDO those changes (list included in
<br />the Agenda) recommended by the Steering Committee and approved by County
<br />staff. Commissioner Privette concurred with the amendment.

<br /> UPON AMENDED MOTION of Commissioner Privette, seconded by Chairman
<br />Fennel with Commissioners Privette, Suggs and Freeman and Chairman Fennel
<br />voting for and Vice Chairman Carruth voting against, the Board moved to table
<br />the proposed Unified Development Ordinance (UDO) until April 2002, to adopt
<br />the following Memorandum of Understanding and to instruct staff to incorporate
<br />into the draft UDO those changes (list included in the Agenda) as recommended
<br />by the Steering Committee and approved by County staff.

<br /> MEMORANDUM OF UNDERSTANDING
<br />BETWEEN THE CITY OF CONCORD, THE CITY OF KANNAPOLIS, THE
<br />TOWN OF HARRISBURG, THE TOWN OF MOUNT PLEASANT AND
<br />CABARRUS COUNTY REGARDING PROCEDURES FOR REVIEWING AND
<br />AMENDING THE UNIFIED DEVELOPMENT ORDINANCE
<br />
<br />Whereas, Cabarrus County, the City of Concord, the City of Kannapolis, the
<br />Town of Harrisburg, and the Town of Mount Pleasant, are experiencing rapid
<br />growth as part of the Charlotte metropolitan region; and
<br />
<br />Whereas, the elected officials of Cabarrus County, the City of Concord, the
<br />City of Kannapolis, the Town of Harrisburg and the Town of Mount Pleasant
<br />recognized the need for an up-to-date, standardized and consistent code of
<br />land development regulations for use in managing growth throughout the local
<br />government jurisdictions; and
<br />
<br />Whereas, the professional staffs of Cabarrus County, the City of Concord, the
<br />City of Kannapolis, the Town of Harrisburg and the Town of Mount Pleasant have
<br />cooperatively prepared a Unified Development Ordinance to serve as that land
<br />development code; and
<br />
<br />Whereas, the elected officials of Cabarrus County, the City of Concord, the
<br />City of Kannapolis, the Town of Harrisburg and the Town of Mount Pleasant
<br />appointed a Steering Committee to work with the professional staffs and
<br />oversee the preparation of the Unified Development Ordinance and make
<br />recommendations to, the planning boards and the elected officials; and
<br />
<br />Whereas, citizens and representatives of the building and development industry
<br />of Cabarrus County, the City of Concord, the City of Kannapolis, the Town of
<br />Harrisburg and the Town of Mount Pleasant have participated with the staffs
<br />and the Steering Committee in the preparation of the Unified Development
<br />Ordinance; and
<br />
<br />Whereas, it is recognized by all those who have participated in the
<br />preparation of the Unified Development Ordinance that there is a need to
<br />provide for coordinated and cooperative evaluation and amendment after its
<br />adoption and the Steering Committee recommends such to the elected officials
<br />of Cabarrus County, the City of Concord, the City of Kannapolis, the Town of
<br />Harrisburg and the Town of Mount Pleasant,
<br />
<br />NOW, THEREFORE, BE IT HEREBY AGREED AND UNDERSTOOD by the elected officials of
<br />Cabarrus County, the City of Concord, the City of Kannapolis, the Town of
<br />Harrisburg and the Town of Mount Pleasant that:
<br />
<br />Following adoption of the Unified Development Ordinance, there will be a
<br />quarterly series of status and evaluation reports regarding the UDO
<br />presented to the Steering Committee, the planning boards and the elected
<br />officials; and
<br />Quarterly reporting will commence with the submission of the first report
<br />in the first week of January, 2001 with three additional programmed
<br />reports to follow in the first week of April, 2001, July, 2001 and
<br />October, 2001; and
<br />Quarterly reports shall include, but are not limited to, the following
<br />information:
<br />a. the experience of each of the five local government jurisdictions
<br /> with UDO administration;
<br />b. examples of any improvements over previous ordinances;
<br />c. examples of any increased problems compared to previous ordinances;
<br />d. examples of any hardships or difficulties experienced by property
<br /> owners, builders and developers that were unforeseen;
<br />e. recommended amendments to correct problems experienced; and
<br />f. recommended amendments to eXPand or enhance the UDO.
