72 <br /> <br />subdivision is connected to the Midland water line that was constructed <br />through the use of an Economic Development Grant. As part of that grant, the <br />North Carolina Commerce and Finance Center requires a reimbursement policy for <br />any users connecting to the water line other than the intended industries. <br />This would result in a $500.00 per lot connection fee for the subdivision. <br />However, Mr. Humphrey objects to the fee due to his donation of the 23-acre <br />parcel and contends he was not informed of the fee. Mr. Marshall reviewed the <br />proposed actions to resolve the subdivision and water line fee issues. He <br />pointed out that the proposal would have to be approved by the Board of <br />Commissioners and the Water and Sewer Authority. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Freeman and <br />unanimously carried, the Board approved the following action concerning the <br />Rocky Meadows Subdivision as proposed by Mr. Marshall: <br /> <br />3 o <br /> <br />Randy Humphrey, Inc., complete the transfer of the 23-acre parcel to <br />Cabarrus County. <br />The Water and Sewer Authority of Cabarrus County (WSACC) transfers the <br />escrow amount of $129,859.00 to Cabarrus County in exchange for the <br />transfer of 13 acres to WSACC. <br />Cabarrus County releases Randy Humphrey, Inc., from his obligated <br />payment of $35,500.00 due to Cabarrus County and pays the State of North <br />Carolina $35,500.00 for the State share of the connection fee. <br />Cabarrus County retains $80,000.00 of the escrow amount (the expected <br />cost of the 13 acres for WSACC) plus an amount equal to half of the <br />connection fee paid to State ($17,750.00). Based on this the County <br />will retain $97,750.00 of the escrow amount. <br />Cabarrus County returns the remainder of the escrow amount to WSACC. <br />The amount returned would therefore be $32,109.00. <br /> <br />Stonewall Jackson Soccer Complex <br /> <br />Proposed Soccer Facility Agreement between Cabarrus County, Cabarrus Soccer <br />Association and the City of Concord <br /> <br />Award of Sprigging/Irrigation Bid ($224,230.50) to H. C. Rummage, Inc.; <br />Approval of Change Order ($30,422.80) to McWhirter Grading Company Contract <br />for Two Holding Ponds; and Approval of Related Budget Amendments (3) <br /> <br /> There was brief discussion regarding the Stonewall Jackson Soccer <br />Complex and the proposed Soccer Facility Agreement. Chairman Fennel pointed <br />out that both the City of Concord and the Cabarrus Soccer Association had <br />approved the proposed agreement. He expressed appreciation to Mr. Bill Jermyn <br />and others who have worked on the project for a number of years. <br /> <br /> The followin9 bids were received on April 12, 2001 for the irrigation <br />and sprigging of the Stonewall Jackson Soccer Complex. The request for bids <br />was published in THE INDEPENDENT TRIBUNE and THE CHARLOTTE OBSERVER on April <br />1, 2001. <br /> <br /> Company <br />H. C. Rummage <br />Piedmont Asphalt Paving <br />Carolina Green Corporation <br /> <br />Total Bid <br /> <br />$224,230.50 <br />$315,777.00 <br />$399,647.94 <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Suggs and <br />unanimously carried, the Board approved the following items concerning the <br />Stonewall Jackson Soccer Complex: (a) Approved the "Agreement for Priority <br />Use of Specified Recreation Facilities Stonewall Jackson Soccer Complex" <br />between Cabarrus County, the Cabarrus Soccer Association and the City of <br />Concord as set forth below; (b) Awarded the sprigging and irrigation contract <br />to the overall low bidder, H. C. Rummage, Inc., in the amount of $224,230.50; <br />approved the change order in the amount of $30,422.80 to the McWhirter Grading <br />Company contract for the company to construct two holding ponds for the <br />soccer complex; and adopted the three budget amendments as shown below. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />Agreement for Priority Use of <br />Specified Recreation Facilities <br />Stonewall Jackson Soccer Complex <br /> <br /> THIS AGREEMENT, made and entered into as of the 23rd day of April, 2001, <br />between the CABARRUS SOCCER ASSOCIATION (~CSA"), a North Carolina youth <br />athletic organization, the CITY OF CONCORD, a North Carolina Municipal <br />Corporation (the ~City") and CABARRUS COUNTY, a political subdivision of the <br />State of North Carolina (the "County") (hereafter, this document may be <br />referred to as the "Agreement"). <br /> WITNESSETH <br /> WHEREAS, the County encourages public and private cooperative funding of <br />public recreation facilities'and improvements; and <br /> WHEREAS, on or about the 23rd day of February, 2000, the County entered <br />in to a 25 year lease with the State of North Carolina (the "Lease") for <br />approximately 39.60 acres adjacent to Stonewall Jackson, Cabarrus County, <br />N.C., for the purpose of developing a soccer complex consisting of <br />approximately 11 new soccer fields and all necessary and attendant grading, <br /> <br /> <br />
