74 <br /> <br />City and CSA Use Fees. The CSA and the City will be allowed to use all <br />Complex fields based on availability and as approved by the Committee <br />and shall not be assessed any fee for such use. <br /> <br />Preparation of Schedules. CSA and the City will present the Committee <br />with a Master Schedule for their respective programs and will be <br />primarily responsible for coordinating and scheduling all soccer <br />programs with the Committee. CSA will present the Committee with a semi- <br />annual Master Schedule for all CSA users within seven days following the <br />final publication of all CSA league schedules for the Spring and Fall <br />seasons. The City will also present the Committee with a Master <br />Schedule for their soccer programs for all City and County participants <br />and will be primarily responsible for coordinating and scheduling all <br />City and County sponsored youth recreational soccer programs. The <br />Committee will then publish a Complex Master Schedule for all Complex <br />users, which will specify practice and game dates for the upcoming six- <br />month period for all Complex fields, including the ten fields assigned <br />to CSA and the City. The Committee must unanimously approve the Complex <br />Master Schedule, including without limitation, all other organizations <br />desiring to use the ten Priority Use Fields, such approval not to be <br />unreasonably withheld. The City and CSA may allow other organizations <br />to use their five Priority Fields as scheduling allows. However, in <br />such event, the City and CSA shall bear sole and exclusive <br />responsibility for such organization's use of the Complex in general and <br />each entity does hereby indemnify and hold harmless any other party <br />hereto against any liability, obligation, cost or expense of any kind or <br />nature arising directly or indirectly from such organization's use of <br />the Complex; including without limitation, bodily injury and death or <br />property damage. <br /> <br />COMPLEX OPERATING COMMITTEE <br /> The County Parks and Recreation Department (the "County Department"), <br /> the City Parks and Recreation Department (the "City Department") and CSA <br /> shall each appoint one member of each of these organizations or entities <br /> to the Committee. The Committee will recommend operational guidelines <br /> for the Complex and oversee the enforcement of such guidelines, <br /> including without limitation, the duties more fully set forth below: <br /> <br />a) Overseeing Complex improvements and the establishment of the biannual <br />Complex Master Schedule for use of the Complex by the City, CSA and the <br />County. <br /> <br />b) Establishment?of a Complex usage fee schedule to help recover related <br />maintenance, utility, development and other expenses when the Complex is <br />used by organizations other than those sponsored by the City, the County <br />or CSA. All such fees and revenue shall belong to the County. <br /> <br />c) Overseeing Equipment purchases. The City, County, CSA, the <br />Committee, as well as any other volunteer youth athletic associations, <br />other entities or individuals may purchase Equipment as needed for the <br />Complex or for special events as such funds become available. However, <br />all Equipment purchases for the Complex must be approved in writing and <br />in advance by the Committee, which shall determine the appropriateness <br />of the general appearance of the proposed purchase. However, the City <br />and CSA shall remain solely and exclusively responsible for the proper <br />installation, inspection, proper function, maintenance, repair, <br />replacement and safety of any Equipment used on its respective Priority <br />Fields. <br /> <br />d) Conducting a quarterly audit of the Complex Priority Use time granted <br />to CSA and the City. Inefficient use of allotted blocks of time, <br />including without limitation, such occurrences as excessive periods of <br />no play, major time periods on individual fields dominated by small <br />numbers, unreasonable withholding of use from the general public or <br />other groups, etc., may warrant a reduction in the Priority Use <br />Commitment of any priority user in any given year, if there is <br />sufficient demand for use of the Complex fields by other groups. <br /> <br />e) Monitoring public use of Complex fields. The general public may be <br />allowed to use the Complex as time permits in the' Complex Master <br />Schedule and as authorized by the County staff at Frank Liske Park. The <br />three U10 size Priority Complex fields will be the only Complex fields <br />used for casual/open play, unless approved by the Committee. <br /> <br />f) Future Development. The Committee will prepare a Capital Improvement <br />Plan for future improvements for the Complex and present their <br />recommendations to their respective governmental bodies. <br /> <br />'COUNTY PARKS AND RECREATION DEPARTMENT RESPONSIBILITIES <br /> The County Department staff at Frank Liske Park will keep and oversee <br /> compliance with the Complex Master Schedule approved by the Committee <br /> and will authorize and schedule casual/open play on the Complex's three <br /> U10 size fields, as the Complex Master Schedule allows. <br /> <br /> <br />
