223

The Board of Commissioners for the County of Cabarrus met in recessed
session in the Multipurpose Room at the Cabarrus County Governmental Center
in Concord, North Carolina on Monday, November 5, 2001, at 6:30 p.m.

Present - Chairman: Arne L. Fennel
Vice Chairman: Robert W. Carruth
Commissioners: Robert M. Freeman
Coy C. Privette
Richard D. Suggs

Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr.
Fletcher L. Hartsell, Jr., County Attorney; Mr. John Day, Deputy County
Manager for Operations; Mr. Blair D. Bennett, Deputy County Manager for
Administration; Mr. Mike Downs, Development Services Director; Mr. Jonathan
Marshall, Planning Services Director; Ms. Dawn McHale, Tax Administrator; Mr.
Don Cummings, Human Resources Director; and Mrs. Frankie F. Bonds, Clerk to
the Board.

Chairman Fennel called the meeting to order at 6:35 p.m.

Courthouse Cabling Pro~ect

Mr. Gene Morris, Clerk of Superior court, requested the Board's
assistance in replacing the outdated cabling in 'the Clerk's Office so that
the State can install new computer equipment that has already been purchased.
There is disagreement between the Administrative Office of the Courts and the
County as to whether the State or the County is responsible for paying for
new cabling. Mr. Morris estimated the cost of new cabling at $15,000.00.

Mr. Clifton discussed the County's expenses for operating the courts,
including maintenance, utilities, furniture, etc. He reported the State paid
to install cabling during the renovation of the third floor of the Courthouse
in 1998-99.

There was discussion as to whether the State or the County should pay
for new cabling in the Courthouse. Issues addressed by the Board included
the following: (1) facility fee revenue paid to the County; (2) the County's
responsibility to provide and maintain adequate courtroom and related
judicial facilities; and (3) varying interpretations of the North Carolina
General Statutes concerning expenses paid by State funds.

UPON MOTION of Commissioner Privette, seconded by Commissioner Suggs
and unanimously carried, the Board directed staff to obtain quotes to install
new cabling in the Clerk of Court's Office and to bring cost estimates to the
Board for approval as soon as possible.

Appointment Policy

A revised Appointment PoliCy with restrictions concerning County
residency was presented to the Board for consideration. The Board had
discussed the residency requirement at its me'eting on October 22.

UPON MOTION of Chairman Fennel, seconded by Commissioner Freeman and
unanimously carried, the Board adopted the following revised Appointment
Policy with the stipulation that those persons who are currently serving on
an appointed board or committee, and reside outside Cabarrus County may
complete their current term of appointment.

POLICY OF THE
CABARRUS COUNTY BOARD OF COMMISSIONERS
Procedures for Appointments to Boards, Committees and Commissions

A. ELIGIBILITY FOR APPOINTMENTS

(SERVICE ON MULTIPLE BOARDS}
The general policy of the Board of Commissioners shall be to
limit membership of an individual to one official governmental
board. The Commissioners, however, reserve the right to appoint
an individual to more than one board under special circumstances.
A person serving on one board and receives an appointment to a
second board shall automatically be removed from the first board,
unless the County Commissioners find evidence of special
circumstances to justify service on two boards. However, the dual
membership provision will not apply to the following: (1)
appointments to regional/area boards; (2) appointments made of a
member of a board in order for that person to represent that
