513 <br /> <br />STATE OF NORTH C/LROLINA <br />COUNTY OF CABARRUS <br /> <br /> THIS AGREEMENT TO MODIFY AND AMEND LEASE AGREEMENT, is made and entered <br />into this day of June, 2000, by and between the COUNTY OF CABARRUS <br /> (hereafter, "County"), and the CHURCH OF GOD CHILDREN'S HOME OF NORTH <br />CAROLINA (hereafter, ~Children's Home"), <br /> W I TNE S SETH: <br /> WHEREAS, on or about February 15, 1999, the County and the Children's <br />Home entered into a Lease Agreement, a copy of which is attached hereto as <br />Exhibit UA" and incorporated as if more fully set forth herein (hereafter, <br />the "Lease") providing (among other things) for the lease of certain property <br />from the Children's Home to the County for purposes of a public park (the <br />"Park"); and <br /> WHEREAS, the County and the Children's Home have agreed to certain <br />modifications and amendments to Exhibit "A" to the Lease, in order to <br />accommodate a redesigned entrance to the Park and the addition of a stop <br />light at the intersection of Orphanage Road, Oakwood Avenue and the proposed <br />new entrance to the Park (hereafter, the "Intersection"); and <br /> WHEREAS, Children's Home owns all four corner plots of land at the <br />Intersection, as the Intersection is shown on Exhibit KB" attached hereto; <br />and <br /> WHEREAS, in order to provide for: (1) acceleration and deceleration <br />lanes approaching the proposed Park entrance and the Intersection; (2) <br />construction and installation of the stoplight; and (3) the construction of <br />the newly designed and relocated entrance road to the Park; all of which <br />improvements are shown on Exhibit "B" hereto (the ~Improvements") Children's <br />Home must provide an easement or right-of-way onto additional pieces of its <br />property and/or lease additional property to the County for these purposes. <br /> NOW, THEREFORE, in consideration of the premises and other good and <br />valuable consideration, acknowledged by the parties hereto to be sufficient, <br />the parties agree as follows: <br /> 1. The parties hereto agree that upon final discussions with the North <br />Carolina Department of Transportation ("NCDOT") to resolve final details <br />regarding construction, and maintenance of some or all of the Improvements, <br />Exhibit "A" to the Lease will be modified and amended by the parties to <br />include an easement, right-of-way and/or additional lease of land across the <br />Children's Home land to allow construction of the Improvements. <br /> 2. Children's Home hereby agrees to grant to the County and to the <br />extent necessary to the NCDOT, an easement, right-of-way and/or lease onto <br />the Children's Home property or properties as needed by the County and the <br />NCDOT for the construction and maintenance of the Improvements. <br /> 3. The parties agree that the Improvements benefit both parties and <br />that further negotiations may be necessary with regard to the Improvements. <br />The parties agree to cooperate with one another and the NCDOT in order for <br />the Improvements to be constructed and implemented. <br /> <br />Witness our hands and seals the day and year first above written. <br /> <br />Attest: <br />/s/ Frankie F. Fennel <br /> <br />CHURCH OF GOD CHILDREN'S HOME <br />OF NORTH CAROLINA, INC. <br />BY: /s/ Donnie Smith <br /> <br />Chairman <br /> <br />Approval of Rec~uest to "Piggyback" a S~orts Lighting Bid Awarded to Musco <br />Sports Lighting on May 15, 2000 to Purchase Sports Lighting for Winecoff and <br />Harrisburg Parks <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Casper and <br />unanimously carried, the Board authorized the purchase of sports lighting for <br />Winecoff and Harrisburg Parks through the "piggyback" purchasing method in <br />accordance with North Carolina General Statute 143-129, using the original <br />sports lighting bid awarded to MUSCO Sports Lighting on May 15, 2000 - based <br />on per fixture cost. The notice of intent to ~piggyback" the bid was <br />published in THE INDEPENDENT TRIBUNE on August 7, 2000. <br /> <br />Approval of the $35,000 Grant from Philip Morris for the Expansion of the 4-H <br />SOS Program at Concord Middle School and Adoption of Budget Amendment <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Casper and <br />unanimously carried, the Board approved the 4-H SOS Grant in the amount of <br /> <br /> <br />
