<br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and
<br />unanimously carried, the Board approved the Heating Appliance Repair and
<br />Replacement Program (Annual Contract), Contract Nuraber 00-4427-38, between
<br />the Salisbury-Rowan Community Service Council and the Cabarrus County
<br />Department of Aging for Fiscal Year 2000-2001. The program funds were as
<br />follows: Administration $700.00; Program Support - $4,280.00; Materials -
<br />$7,200.00; TOTD~L $12,180.00.

<br />Approval of Weatherization Assistance Program Contract with the Salisbury-
<br />Rowan Community Service Council, Inc.
<br />
<br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and
<br />unanimously carried, the Board approved the Weatherization Assistance Program
<br />for Low-Income Persons (A~nual Contract), Contract Number 00-144138(2),
<br />between the Salisbury-Rowan Community Service Council, Inc., the Cabarrus
<br />County Department of Aging; and the Energy Division, North Carolina
<br />Department of Commerce. The funding for the program was as follows: Paid
<br />Labor $19,000.00; Other Program Support - $1,200.00; Materials -
<br />$13,900.00; Administration $900.00; Training: Administrative and Technical
<br />$800.00; TOTAL AWARD - $35,800.00.

<br />Approval of Land Lease Agreement with the City of Kannapolis for Property
<br />Located on Forest Park Drive
<br />
<br /> At a budget work session in May, the Board authorized staff to develop
<br />a lease agreement with the City of Kannapolis whereby county-owned land would
<br />be developed as a park. The land, totaling 13.77 acres, is located south of
<br />Forest Park Elementary on Forest Park Drive in Kannapolis.
<br />
<br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and
<br />unanimously carried, the Board approved the following land lease agreement
<br />with the City of Kannapolis for the Forest Park Drive property and authorized
<br />the Chairman to sign the Lease Agreement on behalf of the County.

<br />LEASE AGREEMENT
<br />
<br /> THIS AGREEMENT is made and entered into this 28tn day of August, 2000,
<br />by and between the County of Cabarrus (hereinafter referred to as "County")
<br />and the City of Kannapolis (hereinafter referred to as "City").
<br /> WITNESSETH:
<br /> WHEREAS, this agreement is executed pursuant to G.S. 16OA-274 and G.S.
<br />153A-165 providing for the lease and joint use of governmental property; and
<br /> WHEREAS, it is the desire of the parties hereto that they enter into an
<br />agreement whereby the City would lease the property described hereinafter
<br />from the County upon terms and conditions set forth therein;
<br /> NOW THEREFORE, upon valuable consideration, the receipt of which is
<br />hereby acknowledged by each party, and upon the premises contained herein,
<br />the parties agree as follows:
<br /> 1.0 Recitals and Prior Aqreement. The recitals contained above are
<br />incorporated herein as a part of this agreement.
<br /> 2.0 Leased Property. Upon terms and conditions set forth herein County
<br />does hereby demise and lease unto City an approximately 13.77 acre tract of
<br />land on the south side of Forest Park Drive, Kannapolis, North Carolina (the
<br />Property), a map of which property is attached hereto as Exhibit "A" and
<br />incorporated as a part of this agreement.
<br /> 3.0 Term. The term of this lease shall be for a period of twenty (20)
<br />years beginning September 1, 2000 and ending at 12:01 a.m. August 31, 2021.
<br /> 4.0 Annual Rent. The rent for this lease shall be one dollar ($1.00)
<br />payable annually in advance on September 1st of each lease year.
<br /> 5.0 use. The Property is accepted for use as a public park and will
<br />be used and developed for such purpose.
<br /> 6.0 Utilities. City will pay for all water, sewer and other utility
<br />charges for services to the Property.
<br /> 7.0 Indemnity and Insurance. City does hereby indemnify and hold
<br />harmless the County for all liability, loss, expenses, including attorney
<br />fees, and costs of any kind or nature whatsoever resulting from any injuries
<br />or damage claims. City shall maintain in force during the term of this lease,
<br />public liability insurance, naming County as an additional insured, with
<br />coverage in an amount of no less than $1,000,000.00 per occurrence. A copy of
<br />said policy or endorsement and each renewal thereof during the term of this
<br />lease shall be delivered to County.
<br /> 8.0 Entry Upon Abandonment. In the event City, at any time during the
<br />term of this lease abandons the Property or any part thereof, County may, at
<br />County's option, retake possession of the Property.
