556 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Council Chambers at the Concord Municipal Building, 26 Union <br />Street, South, Concord, on Thursday, November 9, 2000, at 6:30 p.m. <br /> <br />Present - Chairman: Arne L. Fennel <br /> Vice Chairman: Carolyn B. Carpenter <br /> Commissioner: Coy C. Privette <br /> <br />Absent <br /> <br />Commissioners: Jeffrey L. Barnhart <br /> Sue B. Casper <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. <br />Fletcher L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk <br />to the Board. <br /> <br /> Concord Mayor George Liles and members of the Concord City Council met <br />in joint session with the Board. Mr. Brian Hiatt, Concord City Manager, and <br />other members of the Concord City staff were also present. <br /> <br /> The Cabarrus County Tourism Authority met in joint session with the <br />Concord City Council and the Board of Commissioners. Mr. Mark Shore, <br />Executive Director of the Convention and Visitors Bureau, was also present. <br /> <br /> Mayor Liles stated the purpose of the joint meeting was for the City, <br />County and Tourism Authority to approve a Memorandum of Understanding with <br />John Q. Hammons for the construction of a hotel/conference center at King's <br />Grant. He gave a brief overview of past efforts to locate a civic center in <br />the City of Concord. Also, he recognized Mr. Phil Smith of the Civic Center <br />Commission that was established in 1984. <br /> <br /> Mr. Smith briefly reviewed the past work of the Commission and the <br />selection of the King's Grant area as the site for a civic center. <br /> <br /> Chairman Fennel arrived at 6:40 p.m. and called the meeting of the <br />Board of Commissioners to order. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board moved to go into closed session with the <br />Concord City Council and the Cabarrus County Tourism Authority to discuss <br />real property acquisition as authorized by North Carolina General Statute <br />143-318.11(a) (5) . <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board moved to end the closed session. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board approved the following <br />Memorandum of Understanding among the City of Concord, Cabarrus County, <br />Cabarrus County Tourism Authority and John Q. Hammons Revocable Trust. <br /> <br />MEMORANDUM OF UNDERSTANDING <br /> <br />Among the City of Concord, Cabarrus County, Cabarrus County Tourism Authority <br /> and John Q. Hammons Revocable Trust <br /> <br /> The purpose of this Memorandum of Understanding ("MOU") is to <br />memorialize certain understandings by and among the City of Concord, North <br />Carolina (the "City"), the County of Cabarrus, North Carolina (the "County"), <br />the Cabarrus County Tourism Authority (the "Tourism Authority") and the John <br />Q. Hammons Revocable Trust dated December 28, 1989 as amended (the <br />"Developer") regarding the proposed development (the "Project") of a <br />commercial hotel (the "Hotel") and conference center (the "Conference <br />Center") upon the real property described in Exhibit A and incorporated <br />herein by reference (the "Project Site"). The initial phase of the Project <br />shall consist, among other things, of: (i) a minimum of 300 guest rooms in <br />the Hotel; (ii) approximately 80,000 square feet in the Conference Center, <br />including approximately 40,000 square feet of dedicated meeting space with a <br />main ballroom of approximately 25,000 square feet of column free space, and; <br />(iii) approximately 740 surface parking spaces and approximately 310 garage <br />parking spaces, complying with local zoning regulations as to number, size <br />and designated handicap accessibility. <br /> <br /> This MOU sets forth a summary of the basic terms of the mutual <br />understandings of City, County, Tourism Authority and Developer regarding the <br />contents of a business agreement (the "BA") to be entered into by the parties <br /> <br /> <br />
