562 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina, on Monday, November 20, 2000, <br />at 6:30 p.m. <br /> <br />Present - Chairman: Arne L. Fennel <br /> Vice Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Coy C. Privette <br />Absent - Commissioner: Sue B. Casper <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. <br />Fletcher L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk <br />to the Board. <br /> <br />Chairman Fennel called the meeting to order at 6:30 p.m. <br /> <br /> Junior Girl Scout Troop 241 of Cannon School conducted the Flag <br />Ceremony. Scouts participating in the ceremony were Caroline Barbee, Jessica <br />Booe, Rebecca Kinney, Hanna Klein, Sara Klein, Brianna Kunze, Christina <br />Nolin, Brittany Rumble and Courtney Sneed. <br /> <br /> Reverend Otis Snow of Memorial United Methodist Church gave the <br />invocation. <br /> <br />Approval or Correction of Minutes <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Fennel and <br />unanimously carried, the Board approved the minutes as written for October <br />16, November 6 and November 9, 2000. <br /> <br />Approval of the Agenda <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the Agenda as submitted with the <br />addition of a report on fireworks displays. <br /> <br />RECOGNITIONS <br /> <br /> Chairman Fennel commented on the successful "Convoy of Hope" event that <br />was held at the Fairgrounds on November 18. He thanked all volunteers who <br />assisted with the community event. <br /> <br />OLD BUSINESS <br /> <br />Osprey Lake Subdivision Complaints - Staff Response/Report <br /> <br /> Mr. Clifton reviewed the staff response/report to complaints made by <br />Mr. Mack Neikirk and Mr. Rick Borders, residents of the Osprey Lake <br />Subdivision, at the Board meeting on October 16, 2000. He stated that County <br />staff and Health Alliance staff have investigated the complaints and dealt <br />with those issues for which the County has enforcement power. However, he <br />stated there might be "civil" issues between the homeowners and contractors <br />that could be pursued by the homeowners. <br /> <br /> Mr. Mike Downs, Development Services Director, explained the process <br />for inspecting mobile homes and correcting code violations. <br /> <br /> Mr. Neikirk and Mr. Borders reiterated their complaints that the County <br />has not done its part in correcting the problems in the Osprey Lake <br />Subdivision. They specifically expressed concern that the lake may be drained <br />and stated in their opinion the lake belongs to the homeowners. <br /> <br /> Mr. Randy Wiggins, developer, explained that the North Carolina <br />Department of Environment and Natural Resources (DENR) regulates the lake <br />dam. He stated he is continuing efforts to get the State to reclassify the <br />dam from "high risk" to a low hazard dam. He stated the issue should be <br />resolved by the end of the month. <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, addressed issues <br />concerning the development of the subdivision around the lake. He stated <br />that Mr. Wiggins is taking the proper action to resolve the problems <br />associated with the lake. <br /> <br /> <br />
