573 <br /> <br /> The Board of Commissioners for the County of Cabarrus held an <br />organizational meeting in the Commissioners' Meeting Room at the Cabarrus <br />County Governmental Center in Concord, North Carolina on Monday, December 4, <br />2000, at 6:30 p.m. <br /> <br />Present - Chairman: Arne L. Fennel <br /> Vice Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Sue B. Casper <br /> Coy C. Privette <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. <br />Fletcher L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk <br />to the Board. <br /> <br />Chairman Fennel called the meeting to order at 6:30 p.m. <br /> <br /> Boy Scout Troop 5 of Cold Springs United Methodist Church conducted the <br />Flag Ceremony. Scouts Robbie Alexander, Rex Russell and Michael Chandler <br />participated in the ceremony. <br /> <br /> Reverend David Christy of Epworth United Methodist Church gave the <br />invocation. <br /> <br />Approval or Correction of Minutes <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the minutes of November 20, 2000 <br />as written. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the minutes of closed sessions for <br />the period December 1990 through November 2000 and delegated authority to the <br />County Manager and/or County Attorney to unseal the closed session minutes <br />pursuant to North Carolina General Statute 143-318.10(e). <br /> <br />Additions to the Agenda <br /> <br /> Chairman Fennel asked that the following items be added to the Agenda: <br />(1) Proposed transfer of property (Davidson Tract) by the Cabarrus School <br />Board; and (2) Fairgrounds property, including Letter Agreement, Deed of <br />Property and Lease Agreement. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Chairman Fennel and <br />unanimously carried, the Board approved the addition of the two items to the <br />Agenda as listed by Chairman Fennel. <br /> <br />Davidson Tract of Property - Cabarrus County School Board <br /> <br /> Mr. Clifton explained the proposed exchange of approximately 17 acres <br />(Davidson tract) by the County School Board would provide the required <br />acreage to properly align the schools on the Harris Road site. He advised <br />that grading began this date (December 4) at the site. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Barnhart <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />RESOLUTION <br /> <br />Resolution No. 2000-28 <br /> <br /> WHEREAS, the Cabarrus County Board of Education (the "School Board") <br />owns via condemnation an approximately 17 acre tract of land (the "Davidson <br />Tract") and has named the Cabarrus County Board of Commissioners (the <br />"County") as its agent for the disposition thereof consistent with existing <br />law; and <br /> WHEREAS, J & B Development and Management, Inc. ("J & B"), through <br />itself or a related entity, owns approximately 62 acres of real property (the <br />"School Tract") which it wishes to donate to the County for use for <br />construction of new elementary and middle schools; and <br /> WHEREAS, the School Tract is not of sufficient size to contain all <br />additional school buildings necessary to continue to maintain the level of <br />education in that area of Cabarrus County; and <br /> <br /> <br />
