If the permit is not qranted, the reason for the denial shall be put <br />in written form and delivered to the applicant. <br /> <br />(c)Denial; exceptional permit. If an applicant has been denied a permit under <br />this section and believes the denial is illeqal by virtue of applicable stat~ <br />or federal law, he shall promptly submit a cody of the denied permit <br />application toqether with a short statement of the reasons he believes he is <br /> <br />entitled to a permit to the Sheriff. Further, the Board authorized the County Manager to sign <br />the Easement on behalf of Cabarrus County. <br /> <br />Settinq a Public Hearinq on June 21, 1999 at 6:30 p.m. (or as soon thereafter <br />as persons may be heard) to Consider the Namfnq of an Unnamed Road as Gold <br />Rush Drive <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter <br />and unanimously carried, the Board set a public hearing at 6:30 p.m. (or as <br />soon thereafter as persons may be heard) on June 21, 1999 to consider the <br />naming of an unnamed road (Petition 99-04) as Gold Rush Drive. <br /> <br />Implementation Date for the Mills Corporation Incentive Grant <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter <br />and unanimously carried, the Board approved the request from The Mills <br />Corporation to begin its grant incentive award period for the fiscal quarter <br />beginning April 1, 2001. The company will receive its first incentive <br />payment approximately 30 to 45 days after June 30, 2001. <br /> <br />Midland Second Water Line Aqreement between Cabarrus County, City of Concord <br />and Water and Sewer Authority of Cabarrus County <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter <br />and unanimously carried, the Board approved the following Agreement as <br />amended to include a termination date of June 30, 2002 and authorized the <br />Chairman to execute the Agreement on behalf of Cabarrus County. <br /> <br />MIDLAND SECOND WATER LINE AGREEMENT <br /> <br />THIS AGREEMENT for the MIDLAND SECOND WATER LINE PROJECT (hereinafter <br />referred to as "PROJECT") made and entered into as of the latter of the dates <br />the governing boards approval is set forth herein, by and between the WATER <br />AND SEWER AUTHORITY OF CABARRUS COUNTY, a public corporation of the State of <br />North Carolina (hereinafter referred to as "WSACC"); CABARRUS COUNTY, a body <br />politic and political subdivision of the State of North Carolina (hereinafter <br />referred to as "CABARRUS"); and the CITY OF CONCORD, a municipal corporation <br />(hereinafter referred to as "CONCORD"). <br /> <br /> WITNESSETH: that <br />WHEREAS, CABARRUS and CONCORD have agreed to construct a second water line to <br /> the Midland area and more specifically to the Corning, Inc., and BOC <br /> Gas facilities, at an estimated cost of $2,999,822.93; and <br /> <br /> <br />
