Consideration of Corban Avenue Parkinq Facility Aqreement between the City of Concord and Cabarrus County Mr. Jonathan Marshall, Planning Services Director, distributed a revised Corban Avenue Parking Facility Agreement. He reviewed the proposed changes, including a provision clarifying that the County would pay the invoices and a provision that the County would reserve 25 spaces in the Barbrick Avenue parking facility for City employees. Mr. Clifton suggested that the provision concerning the Barbrick Avenue parking lot be modified to state that the County would offer at a minimum 25 spaces for general use. The Board accepted the proposed change. Commissioner Fennel left the meeting room for a short time. UPON MOTION of Commissioner Casper, seconded by Commissioner Privette with Commissioners Casper and Privette and Chairman Barnhart voting for and Commissioner Carpenter voting against, the Board approved the following Corban Avenue Parking Facility Agreement between the City of Concord and Cabarrus County as amended. The total cost of the parking lot construction was $235,500.00. North Carolina Corban Avenue Parking Facility Agreement Cabarrus County This Agreement of Interlocal Cooperation, pursuant to the terms and conditions of the North Carolina General Statutes, Chapter 160A, Article 20, effective the 1st day of July, 1999, by and between the CITY OF CONCORD, North Carolina (hereinafter referred to as "CONCORD"), and CABARRUS COUNTY, North Carolina (hereinafter referred to as "CABARRUS"); WITNESSETH: THAT - WHEREAS, CONCORD and CABARRUS agree that it is mutually beneficial for the residents, employees and businesses of CONCORD and CABARRUS to cooperate in the construction of a new parking facility on Corban Avenue; and WHEREAS, CONCORD and CABARRUS recognize the importance of providing convenient and safe parking for customers and employees of government services and commercial establishments in downtown CONCORD; and, WHEREAS, CONCORD and CABARRUS wish to coordinate the Corban Avenue Parking Facility with existing public parking areas in downtown CONCORD; and WHEREAS, CABARRUS wishes to construct the Corban Avenue Parking Facility at the lowest cost possible; and WHEREAS, CONCORD has the technical knowledge and skills to oversee the construction of the Corban Avenue Parking Facility as evidenced by the construction of the Bicentennial Parking Facility on Church Street, CONCORD and CABARRUS agree as follows: 1. Purpose. The purpose of this agreement is to establish the fundamental duties of each party to ensure that the parking facility is constructed in a timely and cost efficient manner. 2. Term of Agreement. This agreement shall commence on the date set forth hereinabove following approval and execution by appropriate authority of both CONCORD and CABARRUS, and shall terminate on June 30, 2000 unless both parties agree to extend that time period. After said time period or upon completion and use of the parking facility, CABARRUS shall maintain and operate the parking facility. 3. Undertakinqs of CABARRUS. CABARRUS agrees to provide all engineering and construction documents necessary to construct the parking facility. This shall include any changes that may be necessary to those documents during the course of construction. In addition, CABARRUS agrees to ~omplete those tasks identified on the attached schedule ("Schedule A") or to have those tasks completed by private contractor.
