255 <br /> <br /> Adopted this the 21st day of June, 1999, at a duly scheduled meeting of <br />the Board of Commissioners at the Cabarrus County Governmental Center, 65 <br />Church Street S.E., Concord, North Carolina. <br /> <br />By: /s/ Jeffrey L. Barnhart <br /> Chairman of the Board of Commissioners <br /> for Cabarrus County, North Carolina <br /> <br />Appendix A and Appendix B are on file in the Office of the County Manager and <br />hereby included by reference as a part of the minutes. <br /> <br />Consideration of Corban Avenue Parkinq Facility Aqreement between the City of <br />Concord and Cabarrus County <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, distributed a <br />revised Corban Avenue Parking Facility Agreement. He reviewed the proposed <br />changes, including a provision clarifying that the County would pay the <br />invoices and a provision that the County would reserve 25 spaces in the <br />Barbrick Avenue parking facility for City employees. <br /> <br /> Mr. Clifton suggested that the provision concerning the Barbrick Avenue <br />parking lot be modified to state that the County would offer at a minimum 25 <br />spaces for general use. The Board accepted the proposed change. <br /> <br />Commissioner Fennel left the meeting room for a short time. <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Privette <br />with Commissioners Casper and Privette and Chairman Barnhart voting for and <br />Commissioner Carpenter voting against, the Board approved the following <br />Corban Avenue Parking Facility Agreement between the City of Concord and <br />Cabarrus County as amended. The total cost of the parking lot construction <br />was $235,500.00. <br /> <br />North Carolina <br /> Corban Avenue Parking Facility Agreement <br />Cabarrus County <br />This Agreement of Interlocal Cooperation, pursuant to the terms and <br />conditions of the North Carolina General Statutes, Chapter 160A, Article 20, <br />effective the 1st day of July, 1999, by and between the CITY OF CONCORD, <br />North Carolina (hereinafter referred to as "CONCORD"), and CABARRUS COUNTY, <br />North Carolina (hereinafter referred to as "CABARRUS"); <br /> <br /> WITNESSETH: THAT - <br /> WHEREAS, CONCORD and CABARRUS agree that it is mutually beneficial for <br />the residents, employees and businesses of CONCORD and CABARRUS to cooperate <br />in the construction of a new parking facility on Corban Avenue; and <br /> WHEREAS, CONCORD and CABARRUS recognize the importance of providing <br />convenient and safe parking for customers and employees of government <br />services and commercial establishments in downtown CONCORD; and, <br /> WHEREAS, CONCORD and CABARRUS wish to coordinate the Corban Avenue <br />Parking Facility with existing public parking areas in downtown CONCORD; and <br /> WHEREAS, CABARRUS wishes to construct the Corban Avenue Parking <br />Facility at the lowest cost possible; and <br /> WHEREAS, CONCORD has the technical knowledge and skills to oversee the <br />construction of the Corban Avenue Parking Facility as evidenced by the <br />construction of the Bicentennial Parking Facility on Church Street, CONCORD <br />and CABARRUS agree as follows: <br /> <br />1. Purpose. The purpose of this agreement is to establish the fundamental <br /> duties of each party to ensure that the parking facility is constructed in <br /> a timely and cost efficient manner. <br />2. Term of Agreement. This agreement shall commence on the date set forth <br /> hereinabove following approval and execution by appropriate authority of <br /> both CONCORD and CABARRUS, and shall terminate on June 30, 2000 unless both <br /> parties agree to extend that time period. After said time period or upon <br /> completion and use of the parking facility, CABARRUS shall maintain and <br /> operate the parking facility. <br />3. Undertakinqs of CABARRUS. CABARRUS agrees to provide all engineering and <br /> construction documents necessary to construct the parking facility. This <br /> shall include any changes that may be necessary to those documents during <br /> the course of construction. In addition, CABARRUS agrees to ~omplete those <br /> tasks identified on the attached schedule ("Schedule A") or to have those <br /> tasks completed by private contractor. <br /> <br />Designated personnel from CABD~RRUS assigned to this project will <br />coordinate with the following organizations, at a minimum (a) the Concord <br /> <br /> <br />
