473 <br /> <br /> MEMORANDUM OF UNDERSTANDING <br /> between <br />THE CITY OF CONCORD, THE CITY OF KANNAPOLIS, THE COUNTY OF <br /> CABARRUS, AND THE CABARRUS SOUTH ROWAN URBAN AREA <br /> METROPOLITAN PLANNING ORGANIZATION (MPO) <br /> FOR <br /> PREPARATION OF A UNIFIED DEVELOPMENT ORDINANCE (UDO) <br /> <br />WITNESSETH <br /> <br /> THAT WHEREAS, there is desirability to have the same Zoning and <br />Subdivision Ordinances among all jurisdictions within Cabarrus County <br />in that common regulations would be favorable for citizens, developers <br />and staff; and <br /> WHEREAS the City of Concord entered into a decision to revise its <br />Zoning Ordinance and Subdivision Regulations, through the use of a <br />planning consultant; and <br /> WHEREAS, the City of Kannapolis and Cabarrus County have agreed to <br />participate in the selection of the consultant and in the preparation <br />of both a Zoning Ordinance and Subdivision Regulations into one <br />document, known as a "Unified Development Ordinance: or "UDO;" and <br /> WHEREAS, after interviews and deliberations, the jurisdictions have <br />selected Freilich, Leitener, and Carlisle (hereafter known as "FLC") of <br />Kansas City, Missouri to prepare the UDO, and <br /> WHEREAS, the City of Kannapolis and Cabarurs County have agreed to <br />contribute funding for compensation of FLC; and <br /> WHEREAS, part of the scope of the UDO will include regulations for <br />the provision of adequate public facilities, which will include roads <br />and transportation; and <br /> WHEREAS, drafting and adoption of these provisions of the UDO will <br />forward the transportatio9 planning goals and mission of the MPO; and <br /> WHEREAS, the MPO has in its Planning Work Program available funding <br />for Collector Street Planning, Administrative Controls, and Corridor <br />Planning, which will be part of the UDO. <br />NOW, THEREFORE, the parties hereto do mutually agree as follows: <br />SECTION 1: It is hereby agreed that the City of Concord will act <br />as lead agency in the development of the UDO, and shall be responsible <br />for the compensation of the consultant, as specified in the approved <br />contract. <br /> SECTION 2: It is hereby agreed that the project shall consist of <br />at least four phases, with Phase I of the project beginning <br />immediately, and with Phase II ending on June 30, 1998. <br /> SECTION 3: It is hereby agreed that Cabarrus County and the City <br />of Kannapolis will each advance $25,000 to the City of Concord for <br />Phases I and II. This total of $50,000 shall be added to the $25,000 <br />budgeted by the lead agency. <br /> SECTION 4: It is hereby agreed that the MPO will contribute $10,000 <br />to the City of Concord for preparation of the UDO. <br /> SECTION 5: It is hereby agreed that the City of Concord, the City <br />of Kannapolis and Cabarrus County will each budget $25,000 for Fiscal <br />Year (FY) 98-99, for Phases III and IV, to commence on July 1, 1998. <br />This agreement is contingent upon the inclusion of this amount in the <br />1998-99 budget. If during the progress of the project additional tasks <br />listed under Phase V are necessary, or desired by individual <br />jurisdiction, the respective jurisdiction shall budget separately for <br />those items. <br /> SECTION 6: It is hereby agreed that the jurisdictions will furnish <br />staff, and appropriate documentation, as necessary, to assist the <br />consultant. <br /> <br />Water Charges for the British Oxygen Corporation (BOC)/Corning Community <br />Development Block Orant - Economic Development Pro~ect <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Barnhart and <br />unanimously carried, the Board adopted the following Water Charges for the <br />BOC/Corning Community Development Block Grant - Economic Development Project. <br /> <br /> Resolution No. 1998-02 <br /> CABARRUS COUNTY <br /> WATER CHARGES <br /> FOR THE <br />BOC/CORNING CDBG - ED PROJECT <br /> <br /> <br />
