524 <br /> <br /> the Grantee, prepared in the ordinary course of business. <br /> I. Operational Reports. The following system and operational reports <br />shall be submitted annually to the County upon request: <br /> (1) A summary of the previous year's subscriber totals for Basic Cable <br /> Service and Cable Programming Service tier. <br /> (2) . A projection of system and service plans for the future. <br /> J. Additional Reports. The Grantee shall prepare and furnish to the <br />County at the times and in the form prescribed, such additional reports w'ith <br />respect to its operation, affairs, transactions or property, as may be <br />reasonably necessary and appropriate to the performance of any of the rights, <br />functions or duties of the County in connec%ion with this Ordinance or the <br />Franchise, to such extent as may be necessary to ensure compliance with this <br />Ordinance, the Franchise, or other pertinent provisions of federal law or <br />regulation.. <br />9.3 RECORDS REQUIRED. <br />A. Mandatory Records. The Grantee shall at all times maintain: <br /> (1) A record of all written complaints received and interruptions or <br /> degradation of service experience for the preceding period prior <br /> to a performance review. <br /> (2) A full and complete set of plans, records and "as built" maps <br /> showing the exact location of all cable television system <br /> equipment installed or in use in the County, exclusive of <br /> subscriber service drops. <br />B. Other Records. The County may impose reasonable requests for additional <br />information, records and documents from time to time, as may be reasonably <br />necessary and appropriate to the performance of any of the rights, functions <br />or duties of the County in connection with this Ordinance or the Franchise to <br />such extent as may be necessary to ensure compliance with this Ordinance, the <br />Franchise, or other pertinent provisions of federal law or regulation. <br />X. MISCELLANEOUS PROVISIONS <br /> 10.1 PUBLIC NOTICE. Minimum public notice of any public meeting <br />relating to this Ordinance or the Franchise shall be governed by state and <br />local law. <br /> 10.2 CAPTIONS. The captions to sections throughout this Ordinance are <br />intended solely to facilitate reading and reference to the sections and <br />provisions of this Ordinance. Such captions shall not affect the meaning or <br />interpretation of this Ordinance. <br /> 10.3 FRANCHISE APPLICATIONS. <br /> A. Invitation of Any Applications for an Initial Franchise, Public <br />Notice of each category of service offered including number of pay units sold, <br />new services offered, and the amount collected annually "Request for <br />Proposals." The County may invite applications for an initial cable <br />television Franchise by means of a public notice advertising the availability' <br />of its "Request for Proposals". <br /> (1)The public notice shall contain, but need not be limited to: <br /> (a) A description of the Franchise area which is sought. <br /> (b) A statement that a formal "Request for Proposals" is <br /> available to prospective applicants from a County official <br /> whose name, address, and telephone number are specified. <br /> (c) .A statement that applications for the Franchise must be <br /> submitted in writing in the form and manner specified in the <br /> "Request for Proposals" no later than a day certain. <br /> (d) A statement that all applications will be made available for <br /> public inspection during normal business hours at a <br /> specified location. <br /> B. Request for Proposals. Prior to inviting any applications for an <br />initial Franchise, the County shall prepare a "Request for Proposals" that <br />shall contain, but need not be limited to, the following: <br /> (1) A description of the cable television system and services desired <br /> by the County including any system specifications established by <br /> the County. <br /> (2) A statement specifying the form that all applications shall <br /> follow. <br /> (3) A statement indicating the amount of the application fee (if any) <br /> to be submitted with the application, and the manner in which such <br /> fee is to be submitted. <br /> (4) A statement that all applications must contain the information <br /> required by the "Request for Proposal". <br /> (5)The closing date for the submission of applications. <br /> (6) The name, address, and telephone number of the County official(s) <br /> who may be contacted for further information. <br />C. Requirement for Public Hearing on Reasonable Notice. The County <br /> shall conduct a public hearing prior to awarding any cable television <br /> <br /> <br />
