528 <br /> <br />supplies, rated for at least three (3) hours duration at all optical node <br />locations throughout the distribution network and for twenty-four (24) hours <br />at the headend. <br /> I. Parental Control Feature. Franchisee Shall provide to <br />subscribers, upon request, a converter box with a parental control feature <br />that allows any channel or channels to be locked out. Such converter box with <br />a parental control feature shall block both the video and the audio portion of <br />such channels to the extent that both are unintelligible. Upon.the request of <br />any customer, Franchisee shall block the video and audio portions of all <br />primarily adult programming services to that customer. Franchisee may utilize <br />the option of channel-specific traps. <br /> J. Minimum Interference. All transmission lines, equipment, and <br />structures shall be installed and located so as to cause minimum interference <br />with the rights and reasonable convenience of property owners and at all times <br />kept and maintained in a safe and adequate condition, and in good order and <br />repair. Franchisee shall, at all times, employ necessary and reasonable care <br />and shall install and maintain in use commonly accepted methods and devices <br />for preventing failures and accidents which are likely to cause damage, <br />injury, or nuisances to the public. Suitable barricades, flags, lights, <br />flaxes, or other devices shall be used at such times and places as are <br />reasonably required for the safety of all members of the public. <br /> K. Performance Testing. Franchisee shall perform all system tests <br />and maintenance procedures as required by the FCC and this Franchise and the <br />Ordinance. <br /> L. Technical Standards. The Cable Television System permitted to be <br />operated hereunder shall be installed and operated in conformance with the <br />Ordinance, this Franchise Agreement, and FCC rules and regulations. To the <br />extent permitted by law, any FCC technical standards or guidelines related to <br />the Cable Television System and facilities shall be deemed to be regulations <br />under this Franchise Agreement. At such time as the FCC does not regulate <br />technical standards, Franchisee will continue to comply with the FCC standards <br />which were effective prior to such discontinuance of regulation by the FCC. <br /> M. Notice of Shutdown. Except in an emergency, or the cut-over to <br />the rebuilt system, Franchisee shall use good faith efforts to (1) to do <br />maintenance requiring planned shut downs between midnight and 6 a.m. and (2) <br />to give reasonable advance notice during other periods. <br /> N. Employee Identification. Franchisee shall provide a standard <br />identification document to all employees, including employees of <br />subcontractors, who will be in contact with the public. Such documents shall <br />include a telephone number that can be used to verify identification. In <br />addition, Franchisee shall use its best efforts to clearly identify all field <br />personnel, vehicles, and other major equipment that are operating under the <br />authority of Franchisee. <br /> O. S.tereo. Upon completion of the rebuild, the system will have the <br />capability and shall pass Broadcast Television Systems Committee (BT$C) stereo <br />signals for those broadcast, satellite, and locally originated services which <br />transmit them <br />X. CONSTRUCTION <br /> A. System Design Review. The County shall have the authority to <br />review and comment on the technical design plans to assure that the system <br />design meets the requirements of this Franchise, and the Ordinance. <br />Franchisee shall provide the engineering design maps; key map for design maps; <br />and contact engineer who will be available to discuss project details. The <br />County shall review and offer any comments Or indicate any areas of non- <br />compliance on the system design within forty-five (45) days of receipt of the <br />design information specified herein. The Franchisee shall consider in good <br />faith any comments or notices of non-compliance from the County. The County <br />shall treat the information so provided to the County as confidential and <br />proprietary; provided, however, that each map, document, or other publication <br />shall be plainly marked, "CONFIDENTIAL AND PROPRIETARY BUSINESS INFORMATION OF <br />TIME-WARNER ENTERTAINMENT-ADVANCE NEWHOUSE." <br /> B. Right of Inspection. The County shall have the right to inspect <br />any construction and installation work performed subject to the provisions of <br />this Franchise Agreement, and shall make such tests as it shall find necessary <br />to ensure compliance with the terms of this Agreement and other pertinent <br />provisions of the law over which the County has jurisdiction. <br /> C. Construction Manual. Franchisee shall construct the system in <br />accordance with Franchisee's construction manual. The construction manual may <br />be amended from time to time so long as the standards are in accordance with <br />accepted, good quality engineering practices used by the cable communications <br />industry and comply with relevant law and regulation. <br /> D. Conversion. Subscribers shall not be charged by Franchisee for <br />conversion from the existing system to the new system. In the event that <br /> <br /> <br />
