582 <br /> <br /> Mr. Willis Mann of 3901Dakeita Circle objected to the proposed landfill. <br />He commented on the large amount of waste material to be deposited at the site <br />and stated the completed landfill at a height of 85 feet above the surrounding <br />area would create a poor first impression of the community for persons traveling <br />Highway 601. He stated that 355 persons had signed petitions in opposition to <br />the landfill. <br /> <br /> Mr. William J. Boger, resident of 2370 Flowes Store Road East located less <br />than one mile from the site, objected to the rezoning. He expressed concern <br />about traffic and school bus safety in the area. <br /> <br /> Dr. Thomas A. Baucom of 1632 McManus Road, Midland opposed the location of <br />a landfill on the property. He asked that the request be denied and the <br />residential integrity of the area be maintained. <br /> <br /> Mr. Walt Kiefer of 24 Eastcliff Drive and member of the Cabarrus County <br />Planning and Zoning Commission, supported the denial of the petition. <br /> <br /> No other persons wished to address the Board, and Chairman Casper closed the <br />public hearing at 9:08 P.M. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Barnhart <br />with Commissioners Carpenter, Barnhart and Niblock and Chairman Casper voting <br />for, the Board denied Rezoning Petition C98-01(R) based on the following findings <br />of fact: (1) Character of area will be dramatically changed; (2) Although the <br />Midland Area Plan is meant to be a guide, there is no reasonable relationship <br />between the project and the current usage on adjacent tracts of land; (3) It was <br />unanimously rejected by the Planning and Zoning Commission. <br /> <br />Subdivision Text Amendment [Petition C98-01(S)] Relative to Construction of Turn <br />Lanes - Public Hearinq - 7:00 P.M. <br /> <br /> Mr. Marshall presented the proposed text amendment to the Subdivision <br />Ordinance to require turn lanes in subdivisions containing in excess of 50 lots. <br /> <br /> At 9:15 P.M., Chairman Casper opened the public hearing for Petition C98- <br />01(S) and asked if anyone wished to address the Board regarding this issue. <br /> <br /> Mr. Keith Wayne of 8831 Archer Road, Davidson, questioned the requirement <br />of turn lanes for phased developments that have been approved. <br /> <br /> Mr. Marshall advised that subdivisions that have been approved with phased <br />development would have vested rights. <br /> <br /> Mr. Walt Kiefer, member of the Planning and Zoning Commission, recommended <br />approval of the amendment. <br /> <br /> There was no one else who wished to address the Board, and Chairman Casper <br />closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />with Commissioners Barnhart, Carpenter and Niblock and Chairman Casper voting <br />for, the Board adopted the following Ordinance. <br /> <br /> Ordinance No. 1998-06 <br />PETITION C98-01(S) <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> SUBDIVISION REGULATIONS <br /> <br />BE IT ORDAINED that the Cabarrus County Subdivision Regulations is <br />hereby amended as follows: <br /> <br />Add as Section 66-76F. <br /> <br />Any subdivision that will contain in excess of 50 lots, or create in <br />excess of 500 ADT (as projected by using ITE Trip Generation Manual) <br />shall construct turn lanes at the entrance(s). These turn lanes <br />shall be constructed to NCDOT specifications. <br /> <br />Adopted this the 20th day of April, 1998 by the Cabarrus County <br />Board of Commissioners. <br /> <br /> <br />
