Joyce Garrett, <br />Attorney representing Tanger Properties Limited Partnership, requesting the <br />termination of the Commercial/Retail Development Incentive Grant awarded to <br />Tanger in 1997. According to Ms. Garrett, Tanger has conveyed its property <br />in Concord to The Mills Limited Partnership. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner <br />Carpenter and unanimously carried, the Board agreed to terminate the <br />Commercial/Retail Development incentive grant for Tanger Properties Limited <br />Partnership. <br /> <br />Amendment to the Industrial Development Incentive Grant Aareement with <br />AmeriServe Food Distribution, Inc. - Setting ~ Public H~arinq on October 19, <br />1998 <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Niblock <br />and unanimously carried, the Board set a public hearing on October 19, 1998 <br />at 6:30 P.M. (or as soon thereafter as persons may be heard) to consider an <br />Amendment to the Industrial Development Incentive Grant Agreement with <br />AmeriServe Food Distribution, Inc. The Amendment adds Holberg Industries, <br />Inc. (parent company of AmeriServe) to the Agreement. <br /> <br />Resolution Declarin~ Intent to Close Easements Dedicated for Public Road <br />[Portion of Former Route of Ouav Road (SR 1446)] <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Casper and <br />unanimously carried, the Board adopted the following Resolution. <br /> <br />Resolution No. 1998-34 <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT TO <br />CLOSE EASEMENTS DEDICATED <br /> FOR PUBLIC ROAD <br /> <br /> WHEREAS, at the September 21, 1998, meeting of the Board of <br />Commissioners for Cabarrus County (the "Board"), the Board acknowledged <br />receipt of a Petition to adopt a Resolution and Order (the "Petition") <br />closing a portion of the former route of Quay Road (SR 1446) for a distance <br />of approximately four hundred (400) feet in the vicinity of its intersection <br />with Speedway/Kings Grant Boulevard in Township 2, Cabarrus County, North <br />Carolina, as more particularly described in Exhibit A of the Petition (the <br />"Road"); and <br /> WHEREAS, pursuant to N.C.G.S. 153A-241, it is the intention of the <br />Board to conduct a public hearing to close the Road; and <br /> WHEREAS, the Board desires to notify the public regarding said public <br />hearing on the issue of closing the Road. BE IT THEREFORE, RESOLVED THAT: <br /> 1. A meeting and public hearing on the closing of the Road shall be <br />held before the Board at 6:30 P.M., on the 19th day of October, 1998, or as <br />soon thereafter as persons may be heard. <br /> 2. This Resolution declaring the Board's intent to close an easement <br />dedicated for a public road be published in The Independent Tribune on <br />Tuesday, September 22, and Monday, September 28, October 5 and 12, 1998, and <br />be prominently posted on at least two (2) places along the Road. <br /> 3.
