He presented a revised <br />Resolution for the Board's consideration. <br /> <br />UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br /> <br />and unanimously carried, <br />submitted by Mr. Hartsell. <br /> <br />NORTHCAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />the Board adopted the following Resolution as <br /> <br /> Resolution #1998-35 <br /> RESOLUTION <br />AUTHORIZING THE COUNTY MANAGER <br /> TO LEASE REAL PROPERTY <br /> <br /> WHEREAS, Cabarrus County (the "County") owns a 19.57 acre tract of land <br />located west of and adjacent to Corban Avenue (N.C. Hwy. 73) in Concord, <br />North Carolina, more particularly identified as tax PIN #5630-38-5838 (the <br />"Senior Center Property"), upon which is located the Cabarrus County Senior <br />Center (the "Senior Center"); and <br /> WHEREAS, the Senior Center is a public facility which houses the <br />Cabarrus County Department of Aging and where the County provides services <br />and activities for the senior population of the County and their families, <br />and which serves as a central meeting facility for the community; and <br /> WHEREAS, the L.I.F.E. Center, Inc. (the "L.I.F.E. Center"), is a <br />not-for-profit entity qualified under section 501(c) (3) of the Internal <br />Revenue Code, to which the County is authorized to appropriate funds, and has <br />previously appropriated funds; and <br /> WHEREAS, the L.I.F.E. Center carries out a public purpose in providing a <br />wide range of adult day care and related services generally to and for the <br />senior population of the community consistent with and as a complement to <br />services provided by and through the Cabarrus County Department of Aging at <br />the Senior Center; and <br /> WHEREAS, pursuant to N.C.G.S. 153A-176, 160A-267, 160A-272 and 160A-279, <br />the County desires to lease to the L.I.F.E. Center for a period in excess of <br />ten (10) years, and the L.I.F.E. Center desires to lease from the County a <br />portion of the Senior Center Property for the purpose of the L.I.F.E. <br />Center's construction thereon of an adult day care facility (the "Lease"); <br />and <br /> WHEREAS, the County and the L.I.F.E. Center desire for the Lease to: <br /> (a) Include the southwest portion of the Senior Center Property, as <br />more particularly identified in a survey provided to the County by the <br />L.I.F.E. Center; and <br /> (b) Identify adequate access across and/or joint use of the Senior <br />Center and the Senior Center Property. <br /> IT IS, THEREFORE, RESOLVED that: <br /> 1. The County Manager, on behalf of the County, is hereby authorized to <br />execute and enter into the Lease with the L.I.F.E. Center, Inc., for a <br />portion of the Senior Center Property for the sum of $1.00 and other valuable <br />consideration for a term in excess of ten (10) years and in form and content <br />generally consistent with the draft lease attached hereto and incorporated <br />herein by reference. <br /> 2. A notice summarizing the contents of this Resolution shall be <br />published once subsequent to its adoption. <br /> 3.
