121 <br /> <br />and attachment against the new owner as well as the January 1 owner and to <br />advertise the tax lien in the name of the January 1 owner and the current <br />owner. <br /> <br /> Commissioner Fennel presented the following Resolution requesting <br />support of proposed legislation. <br /> <br />A RESOLUTION REQUESTING LEGISLATION TO CHANGE THE P~ATIO OF SALES TAX <br /> DISTRIBUTION IN THE STATE OF NORTH CAROLINA <br /> <br /> WHEREAS, Cabarrus County is experiencing growth in both citizen and school <br /> population and has a need for more new school construction; and <br /> WHEREAS, the state of North Carolina is experiencing tremendous growth in <br /> revenues from all sources; and <br /> WHEREAS, the good citizens of Cabarrus County overwhelmingly defeated an <br /> attempt to raise the sales taxes an additional 1% to 7% and the <br /> highest in North Carolina to pay for school construction needs. <br /> Thereby confirming that working families and senior citizens can <br /> afford no more new taxes; and <br /> WHEREAS, the overwhelming majority of citizens in Cabarrus County do not <br /> support a resolution endorsing legislation to "reduce debt for <br /> public school facilities" by increasing sales taxes above all <br /> others in North Carolina; and <br /> THEREFORE, BE IT RESOLVED by the Cabarrus County Commissioners that the <br /> Legislature be requested to enact legislation that would: <br /> Reallocate the current 6% sales taxes to a system called <br /> ~Sales Tax 3-2-1." This would be allocated as follows: <br /> 3% to the state for the purposes deemed appropriate by <br /> our elected congressmen, <br /> 2% to the counties. 1% distributed based on <br /> population in the county and the second 1% <br /> distributed to the county in which the sales <br /> occurred, <br /> 1% to the cities based on population in the cities and <br /> unincorporated portions of the counties. <br /> BE IT FURTHER RESOLVED that a copy of this resolution be sent to all <br />county and city governments in North Carolina and be forwarded to the NCACC <br />for inclusion in the 1999 Legislative Goals agenda. <br /> <br /> There was discussion about the proposal, including its submission as a <br />legislative goal and the need for an analysis of the proposed action and its <br />ramifications. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Fennel <br />and unanimously carried, the Board agreed to put forth Commissioner Fennel's <br />proposal to request legislation to change the ratio of sales tax distribution <br />in the State to a system called "Sales Tax 3-2-1" as a recommended <br />legislative goal from Cabarrus County and to send a copy of the proposal to <br />the Chair of all boards of county commissioners in the state for review prior <br />to the Association of County Commissioners Legislative Goals Conference. <br /> <br /> Commissioner Carpenter proposed legislation relating to an increase in <br />the homestead exemption for the elderly. There were varying opinions on the <br />amount of increase in the exemption, whether the exemption should be a fixed <br />or variable amount, the criteria an individual must meet to qualify for the <br />exemption and the implementation of a statewide standard versus a local <br />option. After discussion, Chairman Barnhart asked Commissioner Casper to <br />work with Mr. Hartsell and send a copy of the legislation that was considered <br />during the past legislative session to the Board for review and possible <br />approval as a legislative goal. If Board members agree to the proposed <br />legislation, the Board will consider approval of the requested legislation <br />nunc pro tunc at its January meeting. <br /> <br /> The Board discussed the proposed legislation relating to municipal <br />annexation and incorporation. Chairman Barnhart suggested the need for <br />legislation to regulate annexation across county lines without prior notice. <br />There were varying opinions concerning annexation issues, and the Board took <br />no formal action regarding the proposed annexation legislation. <br /> <br />(c) Desiqnation of Votinq Deleqate <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter <br />and unanimously carried, the Board designated Commissioner Privette as its <br />voting delegate to the North Carolina Association of County Commissioners <br />Legislative Goals Conference on January 14-15, 1999. Further, the Board <br />designated Commissioner Casper as the alternate voting delegate. <br /> <br /> <br />
