398 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special <br />session in the Commissioners' Conference Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, October 13, 1997, at 5:30 P.M. for <br />the purpose of a closed session as authorized by North Carolina General Statutes <br />143-318.11(a)(4). <br /> <br />Present - Chairman: Sue B. Casper <br /> Vice-Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Kenneth Mills <br /> Franklin C. Niblock, Jr. <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. Fletcher <br />L. Hartsell, Jr., County Attorney; Mr. Maurice Ewing, Executive Vice President <br />of the Cabarrus County Economic Development Corporation; Mr. John Murdock, III, <br />Executive Director of the Water and Sewer Authority of Cabarr~,~-G~nty; and Mrs. <br />Frankie F. Bonds, Clerk to the Board. <br /> <br /> Commissioner Carpenter was not present for the beginning of the meeting but <br />arrived for the closed session. <br /> <br />Closed Session as Authorized by NCGS 143-318.11(a)(4) <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Niblock with <br />Commissioners Mills, Niblock and Barnhart and Chairman Casper voting for, the <br />Board moved to go into closed session as authorized by North Carolina General <br />Statutes 143-318.11(a)(4) to discuss matters relating to the location or <br />expansion of industries or other businesses in Cabarrus County. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />and unanimously carried, the Board moved to come out of the closed session. <br /> <br />Proposal for the Sale of County Owned Property <br /> <br /> Mr. Clifton reported the County has received an offer from the Cedar Corp., <br />L.L.C., to purchase approximately 4.754±' acres of County property at the <br />Cabarrus Avenue West/U. S. Highway 601 By-Pass intersection for a purchase price <br />of $300,000.00 per acre or approximately $1,426,200.00. The company plans to <br />develop a retail project at the site. The sale will be subject to the upset bid <br />procedures of the State of North Carolina. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />and unanimously carried, the Board agreed to accept the proposal from the Cedar <br />Corp., L.L.C., listed in the State of Florida, as presented by Jeff Carpenter, <br />currently identified as the Social Services property for $300,000.00 per acre for <br />4.754± acres, subject to conditions as spelled out in the original offer and also <br />subject to the upset bid procedures per State law. <br /> <br />Closed Session as Authorized by NCGS 143-318.11(a}(4} <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Barnhart <br />and unanimously carried, the moved to go into closed session as authorized by <br />North Carolina General Statutes 143-318.11(a)(4) to discuss matters relating to <br />the location or expansion of industries or other businesses in Cabarrus County. <br /> <br /> UPON MOTION of Commissioner Niblock, seconded by Commissioner Barnhart and <br />unanimously carried, the Board moved to come out of closed session. <br /> <br />No action was reported from the closed session. <br /> <br />Adjournment <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Carpenter and <br />unanimously carried, the meeting was adjourned at 6:35 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
