~ 7 <br /> <br /> Board members expressed appreciation to the Transportation Advisory Board <br />members for their work. <br /> <br />Road Closing Request - Portion of Northside Avenue - Supplemental Public Hearing <br />- 7:00 P,M, <br /> <br /> Chairman Barnhart opened the supplemental public hearing at 7:25 P.M. on <br />the request by Comar Industries to close a portion of Northside Avenue in <br />Midland. <br /> <br /> Mr. Jake Helder, Attorney representing Comar Industries, Inc., spoke in <br />support of the closing of approximately 243 feet of Northside Avenue. He stated <br />that the requested closing would not impair transportation in the area as no road <br />has ever existed on the property. Also, Mr. Helder stated the road closing would <br />improve the marketability of the property and add to the tax base of Cabarrus <br />County. <br /> <br /> Mr. Greg Nazareth of Comar Industries supported the closing request, <br />stating that the closing of the right-of-way would deprive no one of access to <br />their property. ~ <br /> <br /> Mr. Gerald Newton, planning and Development Area Manager, and Mr. Hartsell <br />discussed the possible uses of the right-of-way. Mr. Hartsell described <br />Northside Avenue as a "platted access" and questioned whether it could be used <br />for other public purposes such as a sewer line. <br /> <br /> Mr. Robert McCoy of Midland objected to the road closing, stating it is the <br />only free access for sewer in that area. <br /> <br /> Mr. Sherrill Laney of Kannapolis questioned the amount that Comar <br />Industries is willing to pay for the right-of-way property. <br /> <br /> There was no one else to address the Board, and Chairman Barnhart closed <br />the public hearing at 7:56 P.M. <br /> <br /> Commissioner Fennel reported that he and Commissioner Niblock had <br />investigated the road closing request and were recommending denial of the request <br />at this time. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board denied the petition by Comar Industries, Inc. to <br />close a portion of Northside Avenue in the Midland area. <br /> <br />Cabarrus County Water and Sewer Charges for the Stanley Works CDBG-ED Project <br /> <br /> Mr. Newton updated the Board on the Stanley Works Community Development <br />Block Grant-Economic Development (CDBG-ED) project. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock and <br />unanimously carried, the Board adopted the following Resolution. <br /> <br /> CABARRUS COUNTY <br /> WATER & SEWER CHARGES <br /> FOR THE <br />STANLEY WORKS CDBG - ED PROJECT <br /> <br /> WHEREAS, the County of Cabarrus is applying for funding to the <br />North Carolina Commerce Finance Center for the installation of water <br />and sewer to serve the Stanley Works proposed facilities off Highway <br />73 and using Community Development Block Grant funds, and <br /> WHEREAS, the funding source requires a recapture plan of grant <br />monies from connections to the water and sewer lines; <br /> NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners <br />of the County of cabarrus, that: <br /> <br /> Section 1: Future users connecting to the lines funded through <br />the CDBG-ED grant who have not participated financially in the <br />construction of the extension shall be required to pay an assessment <br />fee for each line connection as follows: <br /> <br /> <br />
